The World Bank is supporting the Government of Madagascar (GoM) to address the structural issues of the telecom sector, create a level playing field for private operators and encourage investment to expand digital access and inclusion. Following technical assistance to review the legal and regulatory framework for the telecommunications sector (funded by the Malagasy Digital Governance and Identity Management Project), the GoM has enacted new decrees on (i) licenses and declarations (which ends exclusivities on all segments of the value chain and introduces two additional licenses - namely an unified license and a satellite license), and (ii) interconnection and access (which introduces key principles for interconnection and access such as open access and cost orientation to address dominance and proposes remedies in case of anti-competitive practices). A third decree is also under preparation focusing on management of scarce resources, including spectrum, with further plans to prepare a new Telecommunications Law in the near future, to ensure sustainability of principles of competition, predictability, and transparency advanced through previous decrees. The preparation of the decrees on licenses and declarations is a positive step in creating an environment for healthy competition between telecom operators, but a number of issues still need to be addressed, including the setting of an appropriate price for license fees, the implementation of transparent, fair, economically efficient, and effective spectrum management, and the gradual strengthening of ARTEC to become the strong, independent and well-informed regulator that the sector needs. The existing licenses of all operators will expire by 2025/2026, and discussions for their renewal will start in the coming months. In that context, the World Bank is seeking to hire a consulting firm to support the ongoing reform process, while building the technical capacity of the regulator, with a focus on the transition to the new licensing framework and the management of scarce resources including spectrum costing and allocation.The assignment aims to strengthen ARTEC’s technical and operational capacity to implement robust regulatory practices, with an emphasis on competition, licenses and spectrum management, and to improve its market analysis capabilities. The services performed under this assignment include market research and analysis, technical and advisory services including training and awareness raising to government stakeholders, and the identification of actionable measures by the regulator to foster healthy competition in the sector.
