for the Entire Duration Ixj Additional Terms and Conditions 1 There shall be No Employer-Employee Relationship between the Doj-Nps R02 and the Supplier 2 Doj-Nps R02 Reserves the Right to Request for a Replacement of a Janitor Posted at Anytime For Reasons it may Deem Fit and the Supplier Hereby Undertakes to Replace the Said Janitor when Requested 3 Supplier shall In Accordance with the Provisions of this Contract Fully and Faithfully Furnish All Labor Tools and Equipment And Supervision Related to Janitorial Services Plantscape and Landscape Maintenance and Allied Services for the Doj-Nps R02 Building and its Surrounding Premises Located at Dalan Na Angngicacua Regional Government Center Carig Sur Tuguegarao City Cagayan 4 The Contract Duration shall Take Effect on 01 October 2021 until December 31 2021 and shall Continue from Such Date on a 3 Month Period Unless Otherwise Extended with the Execution of a Supplemental Contract Or Pre-Terminated with Due Notice However Billing Shal be Computed only upon the Date of Actual Deployment Which shall not be Earlier than the Date of Actual Occupancy at the New Doj Building Located at Dalan Na Angngicacua Regional Government Center Carig Sur Tuguegarao City Cagayan 5 The Contract may be Terminated by Doj-Nps R02 at Anytime Prior to its Expiration Upon a Fifteen 15 Day Notice in Writing Given to the Supplier Prior to the Intended Date of Termination 6 The Supplier shall Pay All Janitors Assigned to the Said Doj-Nps Building under this Contract In Accordance with the Minimum Wage Law and Other Such Remuneration and Benefits in Accordance with Law 7 The Supplier shall be Solely Liable and Answerable for Claims If Any That may be Made by the Janitors under the Provisions of the Labor Code Presidential Decrees and Other Relevant Laws 8 All and Whatever Benefits the Said Janitors or Their Heirs may Claim Relative to the Preceding Paragraph in Connection with Their Employment shall be Borne by the Supplier 9 The Doj-Nps R02 shall Pay the Supplier during the Entire Contract Duration of 3 Months Unless Otherwise Extended Which shall be Divided Equally by Month for the Service Provided by the Supplier Corresponding to the Four 4 Janitors Rendering Eight 8 Hours Duty Daily Mondays - Fridays And Holidays If it Falls on a Weekday Payable by the Doj Central Office 10 The Supplier shall be Paid in Semi-Monthly Equal Installment More or Less Due Every 15th and Last Day of each Month Subject to the Availability of Funds and the Usual Accounting and Auditing Requirements The Doj-Nps R02 shall Require the Supplier to Submit the following for Billing Purposes A A Copy of the Payroll Evidencing Payment of Salaries Made B A Certification under Oath that the Same has been Paid to the Security Personnel and C A Quarterly Remittance Report Indicating the Total Contributions Paid for the Account of its Security Personnel on Sss Philhealth Pa-Ibig Bir The Payment shall be Suspended by the Doj-Nps R02 to the Supplier in Case of Non-Compliance of the above In Addition The Supplier shall Also Pay All Personnel Costs under this Agreement Such as A Wages Salaries and Wage Adjustments B Sss Payments and Philhealth Insurance Required by Law and C Government Licensing Charges and Taxes 11Supplier Hereby Agrees that Absences and Tardiness of its Personnel shall be Deducted from its Monthly Billings Computation of Deductions shall be Based on Labor Cost only In Case of Absences of Janitors The Supplier should Ensure that each Assigned Area must be Manned by at Least One 1 Janitor Augmented from Other Areas In the Event of Long Absences or Cumulative Absence of Five 5 Days without Justifiable Reason the Supplier must Make Necessary Adjustment to Form a Replacement of Janitor and a Rapid Test should be Conducted to the Replacement at the Cost of the Supplier In Such Event It will be the Duty of the Supplier to Inform Doj-Nps R02 of Such Replacement 12 The Doj-Nps R02 shall not be Liable for Any Overtime Pay andOr Nightshift Differential Pay to the Janitors Assigned by the Supplier 13 There shall be Four 4 Janitors At Least Two 2 of Them shall be Women 14 The Supplier shall Closely Check the Janitors in the Performance of Their Duties and Responsibilities by Conducting Regular Surprise Inspections Any Time of the Day to Ensure that They are not Committing Any Act Prejudicial to the Interest of the Doj-Nps R02 15 In the Event that Janitors Need to Clean Individual Rooms and Offices It is Incumbent for Them to Ask the Office Staff or Room Occupant to Open and Close the Said Room or Office 16 The Doj-Nps R02 shall not be Responsible for Any Accident Mishap Or Injury of Any Kind or Nature Sustained or Caused by Any of the Janitors Assigned by the Supplier including Death Resulting Therefrom 17 The Supplier shall be Exclusively Responsible for the Enforcement Compliance And Observance of Labor Laws Pertinent Rules and Regulations Governing Employer-Employee Relationship Relating to the Operations Management and Conduct of Janitorial Agencies 18 The Supplier shall Protect the Doj-Nps R02 from Any Liability Arising from Non-Observance of Laws Rules and Regulations Referred to in the Preceding Paragraph AndOr Whatever Claims Cases Either Administrative Civil or Criminal Arising from Non-Compliance with Agreement or Other Laws Or as a Result of this Contract 19 The Supplier shall be Liable to the Doj-Nps R02 for Any Loss or Damage including Theft that may be Incurred upon the Latters Equipment Buildings and Properties Per Inventory List within the Doj-Nps R02 Compound including Additional Items that may be Acquired during Contract Duration When Such Loss and Damage is Caused by the Act Omission Fault or Negligence of the Janitors of the Supplier Assigned as Determined by Doj-Nps R02 Such Loss or Damage shall be Indemnified or Paid for by the Supplier Either by Paying for its Value or by Replacing the Lost Items with New Ones and of the Same or Better Quality of the Lost or Damaged Item At the Option of the Doj-Nps R02 In the Event that the Supplier is Made to Pay for Such Loss or Damage It shall be Subrogated to the Rights of the Procuring Entity against the Party or Parties Responsible The Loss or Damage to Property shall be Brought to the Attention of the Doj-Nps R02 within Twenty Four 24 Hours from its Occurrence or Discovery and shall Immediately be Acted upon by the Supplier 20 To Ensure Compliance with this Undertaking The Supplier shall Furnish the Doj-Nps R02 a Performance Security to Guarantee the Payment of Such Claim for Damage as Well as Those Claims Arising from the Operation of the Contract It is Understood However That the Liability of the Supplier shall not be Limited to the Amount of the Performance Security but to the Actual Loss or Damage that may be Suffered by the Doj-Nps R02 21 Any Unusual Occurrence in the Premises Noted by the Janitors should be Reported Immediately in Writing by the Supplier to the Security Guards and Doj-Nps R02 within Twenty Four 24 Hours from its Occurrence 22 The Supplier must have Sufficient Funds to Cover Payment of Salaries and Other Allowances of Their Security Personnel for Atleast Three 3 Months 23 The Service Agency shall Also Submit the followingA Dole Certificate of No Pending CaseB Nlrc Certificate of No Pending CaseC Sss Assigned must Undergo Rapid Testing within 48 Hours before Their First Day of Work and must have Negative Result 242 Mandatory Wearing of Mask Gloves and Face Shield at All Times While inside the Doj
