Agency 2 The Contract Duration shall Take Effect on 01 October 2021 until December 31 2021 and shall Continue from Such Date on a 3 Month Period Unless Otherwise Extended with the Execution of a Supplemental Contract Or Pre-Terminated with Due Notice However Billing Shal be Computed only upon the Date of Actual Deployment Which shall not be Earlier than the Date of Actual Occupancy at the New Doj Building Located at Dalan Na Angngicacua Regional Government Center Carig Sur Tuguegarao City Cagayan 3 The Service Agency shall Assume Full Responsibility for Any Act Omission or Dereliction of Duty of its Security Guards during Their Assigned Hours the Client shall not be Held Liable to Third Parties Arising from the Said Act or Omission and Freed from Any or All Civil or Criminal Liability Whatsoever 4 The Service Agency shall Provide the Client Six 6 Security Guards 4 Males 2 Females from Mondays Thru Sundays with Two 2 Security Guards with Night Shift All Duly Licensed Qualified Uniformed Well Trained Bonded Properly Armed with the following Qualifications and Requirements A Physically and Mentally FitB Complete with Current Clearances from Barangay Nbi PnpC With Security Guard LicenseD Result of Neuro-Psychiatric ExaminationE Drug Test Result from Government Accredited AgencyF At Least College Level and Computer LiterateG Certificate of Employment from Last EmployerCompanyH Preferably with Driving SkillsI Bio-Data with 1x1 PictureJ Valid Licensed Issued by the Philippine National Police Pnp Supervisory Office on Security and Investigation Agencies Sosia and Padpao 5 The Service Agency shall Provide each Security Guard with Equipment and Materials at its Expense Such as 51 Handheld Radios52 Uniforms53 Nightsticks54 RaincoatsRubber Boots55 Flashlights and First-Aid Kits56 Service Firearms Preferably 9mm Cal Pistols and a Shotgun6 The Security Guards to be Employed or Posted by the Service Agency shall Perform the Security Services Such as But not Limited to the following Activities 61 Inspecting of Bags and Visitors62 Logging in of Visitors in the Record Book63 Locking of EntrancesExits64 Reporting of Unusual Activities or Packages65 Knowledge on How to OperateMonitor Cctv66 Patrolling and Keeping Watch over the Premises Records and Properties67 Securing and Guarding of the Clients Officials and Employees from Any Kind of Threat Harm or Injury within Their Designated Area of Responsibility 68 Such Other Tasks as may be Assigned from Time to Time 7 The Service Agency shall Assume Full Responsibility for Any Loss or Damage Due to Theft Proliferage Robbery Sabotage and Any Form of Trespass Which the Client may Suffer during the Effective Period of this Contract However They shall not in Any Manner be Liable for Any Loss or Damage Caused by Reason of Force Majeure or Fortuitous Event 8 The Service Agency shall not During the Existence of this Contract or Anytime Thereafter Disclose to Any Person or Entity Any Information Concerning the Clients Affairs Which the Service Agency may have Acquired by Reason of this Contract 9 The Service Agency shall Provide Adequate and Responsible Supervision over its Personnel For this Purpose The Service Agency shall Coordinate and Regularly Report to the Chief Security Officer This Department for Special Instructions Directives and Guidance or Office Policies Systems and Proceedings 10 The Client have the Right to Ask for Relief or Replacement of Any Security Guards at Anytime 11 The Service Agency shall be Paid in Semi-Monthly Equal Installment More or Less Due Every 15th and Last Day of each Month Subject to the Availability of Funds and the Usual Accounting and Auditing Requirements The Client shall Require the Service Agency to Submit the following for Billing Purposes A A Copy of the Payroll Evidencing Payment of Salaries Made B A Certification under Oath that the Same has been Paid to the Security Personnel and C A Quarterly Remittance Report Indicating the Total Contributions Paid for the Account of its Security Personnel on Sss Philhealth Pag-Ibig Bir The Payment shall be Suspended by the Client to the Service Agency in Case of Non-Compliance of the above 12 The Service Agency shall Pay All Personnel Costs under this Agreement as A Wages Salaries and Wage Adjustments B Sss Payments and Philhealth Insurance Required by Law and C Government Licensing Charges and Taxes 13 There shall be No Assignment Whatsoever of this Contract to a Third Party 14 There shall be No Employer-Employee Relationship between the Client and the Security Guards Assigned by the Service Agency 15 The Term of this Conract shall be for a Period of Three 3 Months To Commence upon Receipt of Notice of Award However The Client may Upon Written Notice within Thirty 30 Days Rescind the Contract for Failure of the Service Agency to Abide by the Herein Terms and Conditions Set Forth by the Client 15 The Client has the Right to Terminate or Cancel this Contract without the Need of Judicial Action At Anytime before its Expiration on the following Reasonable Grounds Such as but not Limited to A Failure of the Service Agency to Maintain a Very Satisfactory Pergormance Rating B Assigning Security Guards Whose Licenses are Expired and C Violation of Any Such Terms of this Contract 16 The Service Agency shall Promptly Pay the Wages and Salaries of Security Personnel Assigned at the Doj It is Understood that in Case Payment for Security Services is Delayed The Salaries and Wages of Said Security Guard shall be Paid or Shouldered by the Service Agency The Service Agency must have Sufficient Funds to Cover Payment of Salaries and Other Allowances of Their Security Personnel for Atleast Three 3 Months 17 The Service Agency shall Post in Favor of the Client a Performance Bond Equivalent T Thirty Percent 30 of the Total Contract Price to Answer for Any Violation by the Service Agency or Any Provisions of the Contract 18 The Service Agency shall Also Submit the following A Dole Certificate of No Pending CaseB Nlrc Certificate of No Pending CaseC Sss Certificate of No Pending CaseD Philhealth Certifcate of Good StandingE Pag-Ibig Clearnace andF Regular License to Operate19 Covid-19 Related Terms and Conditions 191 All Security Guards that will be Assigned must Undergo Rapid Testing within 48 Hours before Their First Day of Work and must have Negative Result 192 Mandatory Wearing of Mask Gloves and Face Shield at All Times While inside the Doj Compound 193 All Covid-19 Response Items Mask Faceshield Alcohol Gloves Etc that will be Used by the Janitoris Assigned at the Doj-Nps R02 Building must be Provided by the Agency 194 Must Observe at All Times the Office Health Protocol Provided by Doj End
