Construction supervision will be carried out for the construction works: "Construction of a photovoltaic plant for self-consumption and partial climate control of the building "Sv. Sv. Cyril and Methodius 1894" in Topolovgrad city", financed by the project "Energy renovation of the building "Sv. Sv. Cyril and Methodius 1894" in Topolovgrad city" in accordance with Administrative Agreement No. 26/Г.6/03/005332-C01 for the provision of non-reimbursable financial assistance under the Strategic Plan for the Development of Agriculture and Rural Areas of the Republic of Bulgaria for the period 2023-2027, Intervention "II.G.6 - Investments in basic services and small-scale infrastructure in rural areas". The public procurement covers: the execution of construction supervision during construction for all types of construction works that are carried out by the contractor of the corresponding object, in accordance with the legal powers and obligations of the contractor as a party exercising construction supervision on the construction, as regulated in Articles 166, 168, 176a of the Construction Law (ZUT). Construction supervision will be carried out within the mandatory scope in accordance with the requirements of the ZUT, the requirements of Decree No. 3 of 2003 for the preparation of acts and protocols during construction, taking into account the requirements of Decree No. RД-02-20-1 of February 5, 2015 for the conditions and procedures for the use of construction products in construction works of the Republic of Bulgaria by the National Construction Control Directorate (MRRB), Decree No. 14/20.02.2015, and all legal and subordinate regulatory acts in the field of construction in Bulgaria. The construction supervision service aims to ensure the quality execution of construction works, with a qualified consultant monitoring the process. The consultant will carry out "Construction supervision" under the Territorial Organization Law, and must possess a Certificate/License for the exercise of construction supervision issued by the National Construction Control Directorate (MRRB) of the Ministry of Regional Development and Urban Renewal (MRRB) in accordance with Article 166, paragraph 2 of the ZUT for the performance of the activity. CONCRETE RESPONSIBILITIES: Construction supervision: The contractor bears responsibility for the activities and obligations as a participant in the investment process, as regulated in Articles 166 and 168 of the ZUT, as well as those arising from Article 178 of the ZUT, and other applicable provisions of the current legislation. Construction supervision will be carried out within the mandatory scope in accordance with the requirements of the ZUT, the requirements of Decree No. 3 of July 31, 2003 for the preparation of acts and protocols during construction, taking into account the requirements of Decree No. RД-02-20-1 of February 5, 2015 for the conditions and procedures for the use of construction products in construction works of the Republic of Bulgaria by the National Construction Control Directorate (MRRB), Decree No. 14/20.02.2015, and all legal and subordinate regulatory acts in the field of construction in Bulgaria. SCOPE OF SERVICE: Construction supervision The construction supervision will be carried out in the volume and scope in accordance with the requirements of the ZUT and the relevant subordinate regulatory acts, while carrying out at least the following activities, distributed in two main groups: Main activities: 1) Construction supervision on the implementation of construction works in accordance with the approved investment project and the requirements of regulatory acts: 1.1. Control and comparison of executed works with the scope and content of the investment project; 1.2. Control and comparison of executed works with the requirements of applicable current legislation. 2) Inspection of executed construction works and signing of acceptance protocols prepared by the contractor: 2.1. Presence on site and observation and control of current quantities and types of works being executed; 2.2. In result of the execution of sub-activity 2.1, as well as in relation to the results of the execution of works within activity 1 - a thorough review of the acts provided by the contractor, and in case of conformity, signing the executed works. 3) Ensuring the preparation of acts and protocols in accordance with Decree No. 3/2004, before, during, and after construction works: 3.1. Preparation of acts and protocols before the start of construction works; 3.2. Preparation of acts and protocols during construction works; 3.3. Preparation of acts and protocols after completion of construction works. 4) Control of environmental protection during construction works in accordance with the Environmental Protection Law (ZOS) and the Waste Management Law and related decrees: 4.1. Detailed preliminary study of the requirements of applicable current legislation, as well as the content of the approved project; 4.2. In result of sub-activity 4.1, as well as in connection with the continuous presence of representatives of the contractor on the site - creation and implementation of an environmental protection control system.
