BEMU units in the Ústí Region – Plum Railway II.

The AŽD Prague s.r.o. in Czech Republic from Europe region has released this tender for The contracting authority is preparing the acquisition of four (4) new BEMU railway vehicles with electric battery drive (hereinafter also referred to as the “Guaranteed Number” and “Vehicles”) for the purposes of their future use in providing public services in passenger transport by rail for the Ústí nad Labem Region as part of the operational set of BEMU units of the Švestková dráha. The Ústí nad Labem Region declared its intention to conclude a contract with the contracting authority for public services in passenger transport by rail for this purpose for a period of 15 transport years, with an expected start date of 2030 (with a possible postponement of the start of performance to 2032). The technical, quality and safety requirements for the vehicles to be acquired are largely based on the requirements set by the Ústí nad Labem Region for their future use in providing transport services in the region. The contracting authority has reflected these requirements to an appropriate extent in the tender conditions of this public contract. In connection with the planned acquisition of the Vehicles and their future use for the provision of public services for the Ústí nad Labem Region, the contracting authority intends to seek co-financing of the Vehicles within the 2nd round of the call from the TRANSGov program: Modernization of Public Transport (call number ModF: TRANSGov No. 1/2024). The contracting authority therefore (potentially) meets the definition of a contracting authority pursuant to Section 4(2) of the Public Procurement Act. With regard to the intended co-financing of the Vehicles, the contracting authority requires that the participants in the tender procedure familiarize themselves in detail with the terms and conditions of the above-mentioned subsidy program, including the terms of the relevant call, to the extent relevant to the subject of this public contract. The participants are obliged to take these terms into account when processing their bids and to respect them during the subsequent performance of the public contract, if they apply to its performance. The public contract is awarded in a negotiated procedure with publication pursuant to Section 60 of the Public Procurement Act, because the contracting authority, with regard to the conditions of the Tender Procedure, has concluded that its specific need cannot be satisfied without adequate adjustment of the solutions already available on the market and due to the complexity of the subject of performance, the fact that the technical conditions of the subject of performance cannot be sufficiently defined only by reference to technical standards within the meaning of Section 90, paragraphs 1 and 2 of the Public Procurement Act and its direct link to the conditions of the Tender Procedure, it is necessary to hold negotiations with the participants in the tender procedure. The purpose of this above-the-limit public contract for supplies awarded in a negotiated procedure with publication pursuant to the provisions of Section 60 et seq. of the Public Procurement Act is to conclude a contract for the supply of Vehicles together with the provision of service services and further the possibility of exercising the option right beyond the Guaranteed Number and to extend the period of provision of service services, all within the meaning of Section 2.9 of this tender documentation.
