The Ředitelství vodních cest ČR in Czech Republic from Europe region has released this tender for Předmětem Rámcové dohody je v souladu s ustanovením § 131 a násl. ZZVZ úprava podmínek pro poskytování právních služeb mezi vybraným dodavatelem a zadavatelem po dobu účinnosti Rámcové dohody (dále též „právní služby“), jakož i úprava podmínek, na jejichž základě budou mezi zadavatelem a vybraným dodavatelem zadávány dílčí veřejné zakázky podle aktuální potřeby zadavatele. Dílčí veřejné zakázky budou zadávány prostřednictvím prováděcích smluv (dále též „Prováděcí smlouva“). Prováděcí smlouvy budou uzavírány postupem podle ustanovení § 134 odst. 1 ZZVZ, tj. postupem bez obnovení soutěže, přičemž bližší podmínky uzavírání Prováděcích smluv jsou uvedeny v článku 2 Rámcové dohody. Právní služby se budou týkat oblasti investiční výstavby Klienta a budou spočívat v aplikaci zejména následujících právních předpisů: -Zákon č. 114/1992 Sb., o ochraně přírody a krajiny, -Zákon č. 114/1995 Sb., o vnitrozemské plavbě, -Zákon č. 100/2001 Sb., o posuzování vlivů na životní prostředí, -Zákon č. 254/2001 Sb., o vodách a o změně některých zákonů (vodní zákon), -Zákon č. 416/2009 Sb., o urychlení výstavby dopravní, vodní a energetické infrastruktury, -Zákon č. 283/2021 Sb., stavební zákon. Právní služby budou spočívat zejména v následujících činnostech potřebných pro výkon činností v rámci celé šíře působnosti zadavatele: i. poskytování odborných konzultací a porad, ii. zpracovávání právních analýz, stanovisek a rozborů, iii. sepisu a revizi metodik a vnitřních předpisů, iv. sepisu a revizi smluvní dokumentace a dalších právních dokumentů, v. zastupování zadavatele při jednání před orgány veřejné moci, vi. zastupování zadavatele při jednání s třetími osobami. Předmětem Rámcové dohody je v souladu s ustanovením § 131 a násl.
