Procurement of refrigeration machine maintenance and repairs – contract amendment

The Tampereen kaupunki in Finland from Europe region has released this tender for The City of Tampere's sports services have a valid contract for the procurement of refrigeration machine maintenance and repair services with Cervi Talotekniikka Oy (decision of the Director of Sports and Youth Affairs of 11.6.2024 § 84, TRE:5543/02.07.01/2023). The actual value of the procurement contract excluding VAT during the actual contract period is approximately 400,000 euros. The actual contract period was 8.7.2024–7.7.2026. By its decision of 2.2.2026 § 9, the Director of Sports and Youth Affairs has implemented the one-year option period included in the procurement contract for the period 8.7.2026–7.7.2027. The option period will be implemented with Cervi Talotekniikka Oy on the original terms. Cervi Talotekniikka Oy approves the amendment to the contract. During the contract period, unforeseen breakdowns have occurred in the ice rink refrigeration machines, which has resulted in a significantly higher need for maintenance and repair than estimated when preparing the procurement. The maintenance and repair costs caused by these defects could not have been anticipated during the planning phase of the original procurement. As a result, the estimated value of the procurement contract has been fulfilled earlier than estimated. According to Section 136(2) of the Public Procurement Act, a change may be made to the procurement contract during the contract period without a new procurement procedure if the original contracting partner needs to perform additional services that were not included in the original procurement, and changing the contracting partner is not possible for financial or technical reasons, or if changing would cause significant inconvenience to the contracting entity or significant duplication of costs. The value of such a contract change may not exceed 50 percent of the value of the original contract. In maintenance and repair work on the refrigeration machines of ice rinks and artificial ice rinks, the service provider is required to have knowledge of the equipment of the sites, management of maintenance history data and the readiness to respond to urgent repair work. Changing the service provider during the contract period would cause significant operational disruption and additional costs and would jeopardize the uninterrupted use of the sports facilities. In addition, changing the service provider would require the new operator to familiarize themselves with the technical systems, maintenance history and practical operating models of the sites. This would increase the risk of downtime and delays and weaken the ability to react quickly to sudden fault repairs. In order to secure the occupancy rate of the sports facilities and the continuity of services, it is justified that the services are provided by the current contract partner also during the option period. The value of the contract amendment has been estimated at approximately 200,000 euros (VAT 0%), which corresponds to a maximum of 50 percent of the realized value of the procurement contract. However, the final realized value of the contract amendment will only be determined during the option period. The value of the amendment therefore does not exceed the maximum amount laid down in Section 136 of the Procurement Act. The amendment will be implemented as a single contract amendment, and its aim is not to circumvent the provisions of the Procurement Act.The City of Tampere Procurement Services will initiate the preparation of a new tender. In connection with the new tender, the estimated value of the procurement will be defined more precisely than before in order to avoid similar situations in the future. In addition, the scope of the procurement, risk factors and possible future maintenance and repair needs will be assessed in more detail than before so that the total value of the procurement corresponds as closely as possible to the actual need for the service throughout the entire contract period.
