Dynamic procurement system for the construction of FTTB networks

The Breitband Ortenau GmbH Co.KG in Germany from Europe region has released this tender for The procurement procedure will be conducted as a dynamic purchasing system in accordance with Section 4b EU Paragraph 1 of the German Construction Contract Procedures (VOB/A) in conjunction with Sections 22, 23, and 24 of the German Procurement Ordinance (VgV) using a restricted procedure. The dynamic purchasing system is being established to award the construction services for the installation of the subsidized passive fiber optic network for Breitband Ortenau GmbH & Co. KG in the Ortenau district to suitable companies. The dynamic purchasing system is an exclusively electronic procurement procedure that remains open throughout its entire duration. First, the suitability of the companies will be assessed, and suitable applicants will be added to the system. For each specific requirement, all approved companies will be invited to submit a bid. New companies can submit an application to participate at any time during the systems operation; these will be admitted to future individual procurements, provided they meet the defined suitability criteria. In the prequalification stage (first stage of the procedure), any interested company can submit an application to participate. At this stage, the companies will be assessed for their suitability and the absence of grounds for exclusion based on the submitted documents. No bid documents need to be submitted at this stage! Companies can apply for inclusion in the dynamic purchasing system and have their suitability for the respective individual tenders assessed at any time during its duration. The contracting authority will review the applications received within 10 working days in accordance with Section 24 Paragraph 3 Sentence 1 of the German Procurement Ordinance (VgV) and inform the applicants immediately of their acceptance or rejection. Attention is drawn to Section 24 Paragraph 3 Sentence 2 of the VgV. Accepted companies will then be invited to submit a bid for each subsequent individual tender, provided they meet the eligibility criteria for the respective individual tender (reference types 1-3) (see Chapter VI.5.1 of the Conditions of Application). The first request for proposals is scheduled for early June 2026. Companies that are not yet accepted at the time a request for proposals is sent cannot be considered for the individual tender in question. However, if accepted, they will be considered for subsequent individual tenders. Based on the published award criteria, the most economically advantageous tender will be determined and awarded the contract (price will be the sole criterion). The requirements for the tenders and the terms and conditions for each procurement measure will be communicated in the respective request for tenders.
