Tender Summary
The BITMARCK GmbH in Germany from Europe region has released this tender for BITMARCK GmbH (“BITMARCK”) (then still operating as BITMARCK Service GmbH) issued a Europe-wide tender for an EVB-IT system contract for the creation and commissioning of an electronic patient record (“ePA”) approved by gematik GmbH (“gematik”) as a complete system, in accordance with the legal framework, and for subsequent system services. On June 28, 2019, the contract was awarded to Research Industrial Systems Engineering (RISE) Forschungs-, Entwicklungs- und Großprojektberatung GmbH (“RISE”). Since January 15, 2025, health insurance funds have been obligated under Section 342 Paragraph 1 Sentence 2 of the German Social Code, Book V (SGB V), to provide every insured person who, after prior notification pursuant to Section 343 SGB V, has not objected to the establishment of an ePA to their health insurance fund within a period of six weeks, with an ePA approved by gematik pursuant to Section 325 Paragraph 1. According to Sections 325 Paragraph 1 and 326 of the German Social Code, Book V (SGB V), providers of components and services of the telematics infrastructure (“TI”) must possess the authorization required under Section 325 Paragraph 1 SGB V before using the TI. Pursuant to Section 325 Paragraph 2 SGB V, gematik authorizes the components and services of the TI upon application by the providers, provided the components and services are functional, interoperable, and secure. gematik tests the functionality and interoperability of TI components and services based on the test criteria it publishes (Section 325 Paragraph 3 Sentence 1 SGB V). These test criteria are technical specifications pursuant to Section 311 Paragraph 1 Number 1 SGB V, which are developed and prescribed by gematik (simply put: “specifications”). These specifications contain, on the one hand, requirements for the TI products used (so-called “product type versions”). The specifications are not static, however; new versions for the product type versions are continuously adapted by gematik and published through releases that bundle several new versions of different product and provider type versions. Following a prior amendment to the contract, the TI Messenger ePA Client module ("TI-M ePA Client") and the prescription client module or e-prescription-FdV ("eRP-FdV") were added to the overall ePA system, thus expanding it into the TI-App system. The term "TI-App system" describes the overall system that was created based on the ePA system contract and that emerged from the overall ePA system. The term "TI-App" describes the product that BITMARCK provides to its customers. Components of the TI-App include further components, e.g. For example, the sIDP, e-prescription specialist service, and TIM specialist service ePA, which are not part of the overall TI-App system or formerly the overall ePA system, as they are not part of the ePA system contract. On March 25, 2026, gematik issued a statement regarding ePA-FDV (gemProdT_ePA_FdV_PTV_3.1.3-2) and regarding the ePA file system (gemProdT_Aktensystem_ePA_PTV_3.1.3-2) New specifications will be issued, as well as on October 2, 2025, regarding the e-prescription (gemProdT_eRp_FdV_PTV_1.9.0-0). This amendment to the contract obligates RISE to adapt the current TI-App system to the new gematik specifications and to provide BITMARCK with an enhanced release, in accordance with technical agreements between RISE and BITMARCK, by the target dates agreed upon in the milestone plan. Furthermore, the new features added in ePA 3.1.3-2 require additional hardware resources (VAUs and HSM appliances), which RISE is to sell to BITMARCK and add to the TI-App system. VAUs and HSMs are already components of the overall system and thus of the ePA product. Additional service VAUs and HSMs are now required to mirror/support the feature adjustments to the ePA software required for this order change by providing the necessary hardware resources ("hardware expansion"). with tender notice no. 712772-2026 published on 15 Oct 2026. The tender is due to expire on 13 Jan 2027.
