Basic Offer: The basic offer requests natural gas for the first delivery year without any special production requirements. For the second delivery year, the gas supply owed is additionally governed by the mandatory legal requirements applicable for that delivery year. If a legally mandated green gas quota, a legally required special gas component, or a comparable legal requirement applies to the gas supply covered by this contract, the required component is included in the owed gas supply. The type, quality, quantity, calculation, allocation, and verification of this component are governed exclusively by the applicable minimum legal requirements and the supplementary provisions of the service description. A quota exceeding the minimum legal requirements or a higher gas quality than that stipulated by the minimum legal requirements is not required within the scope of the basic offer. No special production requirements are specified for the remaining component that is not required to be supplied in a specific type or quality due to mandatory legal requirements. Unless a legally mandated green gas quota or comparable legal requirement applies to the gas supply covered by this contract for the second delivery year, natural gas without specific production requirements will be requested for the entire gas supply. Alternative Offer 90/10: Under the Alternative Offer 90/10, a gas supply is requested for each delivery year that generally consists of: • 90% natural gas and • 10% gas compliant with the German Gas Modernization Act (GModG). The aforementioned proportions generally refer to the total energy quantity actually delivered in the respective delivery year. The decisive factor is the energy content in kWh. The GModG-compliant gas component must meet the requirements specified in Section 8.4 of the service description, in particular regarding type, quality, origin, allocation, balancing, and documentation. The 10% GModG-compliant gas component is a mandatory part of the Alternative Offer for each delivery year. If mandatory legal requirements for a specific gas share or a comparable legal fulfillment instrument apply to the gas supply covered by this contract during a delivery year, and the GModG-compliant gas share provided as part of the alternative offer is creditable against this obligation under the applicable legal provisions, the creditable share will be credited against the legal obligation. Double procurement, allocation, or remuneration of the same energy quantity or the same legal fulfillment effect is excluded.If the legally required share exceeds the share provided under the alternative offer and eligible for legal credit, or if the GModG-compliant gas share provided under the alternative offer is only partially or not at all eligible for credit towards the legal obligation, the special provisions of the service description apply to the remaining legally required share. If this results in an additional legally required special gas share being included within the total delivery quantity, the remaining natural gas share is reduced accordingly. The total delivery remains at 100% of the respective total quantity. For the GModG-compliant gas share, the bidder must offer a separate fixed price for each delivery year in accordance with the service description. The GModG fixed prices offered for the delivery years 2027 and 2028 may differ. For the natural gas component, energy pricing is governed by the pricing and price fixing mechanism specified in the service description.
