The purpose of the service concession is to enable the leasing and operation of a passive gigabit broadband network to be constructed in the expansion area. In this context, reference is made to the exception in Section 149 No. 8 of the GWB. ============================================================== Thüringer Glasfasergesellschaft mbH (hereinafter referred to as the "License Grantor") intends to lease a subsidized passive gigabit broadband network to a telecommunications company and to commission the Licensee to operate this gigabit broadband network. The Licensee shall operate the gigabit broadband network for at least the minimum operating period of seven full years stipulated by the subsidy regulations, following the network's completion. The Licensee shall equip the passive broadband infrastructure to be constructed by the License Grantor with active network components, operate it during the contract term, maintain it at its own expense, and ensure comprehensive, reliable broadband internet access and corresponding services at market prices throughout the expansion area and for all subscribers located therein, taking into account open access. The concession grantor has applied for funding under the guideline "Funding to support the expansion of gigabit telecommunications networks in the Federal Republic of Germany" (Gigabit Guideline 2.0) within the framework of funding item 3.2 (operator model). The contracting authority has also applied for co-financing to supplement the federal funding under the "Directive of the Free State of Thuringia for the Promotion of the Expansion of Gigabit-Capable Broadband Infrastructures (Gigabit Directive)."
