The use of subcontractors is not permitted for the aforementioned critical tasks. This procurement procedure is subject to Commission Implementing Regulation (EU) 2025/1197 of 19 June 2025. The contracting authority will therefore stipulate the following contractual obligations for the contractor: During the term of the contract, the contractor must ensure that goods supplied or services rendered in performance of the contract that originate in the People's Republic of China do not exceed 50% of the total contract value, regardless of whether these goods or services are supplied or rendered directly by the contractor or by a subcontractor. The contractor is obliged to provide the contracting authority with suitable evidence of compliance with this obligation upon request, at the latest upon delivery. In the event of non-compliance with this obligation, the contractor is obliged to pay a penalty fee of 30% of the total contract value, based on the total price in accordance with Annex 5 – Price List.
