Introduction This announcement is used solely to make known to interested parties the intended choice of procedure, being the intention to conclude an agreement with Volkswagen dealer Van den Udenhout in Breda by invoking the negotiated procedure without announcement pursuant to Article 2.32, paragraph 1, sub b, sub 2 of the Public Procurement Act 2012 in conjunction with Article 4.16 et seq. of the Public Procurement Act 2012. The purpose of this is to enable interested parties to raise any objections within the time limit attached thereto. The Contracting Authority for the agreement is the Municipality of Breda, hereinafter referred to as: “The Contracting Authority”. Motivation for chosen procedure & intended agreement The Contracting Authority justifies its choice to make use of Article 2.32, paragraph 1, sub b, sub 2 of the Public Procurement Act 2012 as follows, based on three cumulative criteria: competition is absent for technical reasons, there is no reasonable alternative or substitute, and the absence of competition is not the result of an artificial restriction of the terms of the tender.
