The Contractor must price the proposed packaging method using appropriate conversion. 5. Deliveries will be made successively, in the quantity and assortment, in accordance with the Ordering Party's partial orders, within 2 days of the date of order placement. The Contractor will be obligated to deliver the ordered assortment to the Hospital Pharmacy at its own expense. 6. The Ordering Party requires that the prices of the offered drugs are not higher than the official prices specified in Art. 9, paragraphs 1 and 2 of the Act of 12 May 2011 on the Reimbursement of Drugs, Foodstuffs for Particular Nutritional Uses and Medical Devices (Journal of Laws of 2025, item 907), applicable on the date of offer submission – if applicable. 7. Offered medicinal products must comply with the Act of 6 September 2001 – Pharmaceutical Law (Journal of Laws of 2026, item 612) – if applicable. Offered medicinal products must be admitted to trading in Poland under the terms specified in Art. 3 or 4a of the Pharmaceutical Law. 8. Offered medical devices must comply with the Act of 7 April 2022 on medical devices (Journal of Laws of 2024, item 1620) and in implementing acts issued on the basis of that Act – if applicable. 9. If the Contracting Authority has used in the description of the subject of the contract designations of standards, technical assessments, technical specifications and technical reference systems referred to in art. 101 sec. 1 item 2 and sec. 3 of the Public Procurement Law, equivalent solutions are permitted. Whenever a standard is indicated in these ToR or annexes to the ToR, it should be assumed that the phrase “or equivalent” has been used in reference to it. If the description of the subject of the contract refers to standards, technical assessments, technical specifications and technical reference systems referred to in sec. 1 item 2 and sec. 3, the ordering party may not reject the offer only because the offered supplies do not comply with the standards, technical assessments, technical specifications and technical reference systems to which the description of the subject of the order refers, provided that the contractor proves in the offer,in particular, using the means of evidence referred to in Art. 104-107, that the proposed solutions meet the requirements specified in the description of the subject of the contract to an equivalent degree. 10. The Ordering Party requires that offers be submitted electronically. A detailed description (instructions) for submitting offers in electronic form is included in Section XIV of the ToR. The Ordering Party hereby informs that in this public procurement procedure, the so-called "reverse order of offer evaluation" referred to in Art. 139 of the Public Procurement Law will be applied. Using the above procedure, the Ordering Party will first examine and evaluate the offers, and then subjectively qualify the contractor whose offer was rated the highest in terms of the absence of grounds for exclusion and compliance with the conditions for participation in the procedure. 14. The Contractor may entrust the performance of part of the contract to a subcontractor. 15. The Ordering Party does not allow the submission of variant offers. 16.
