4.1. The subject matter of the order comprises: 4.1.1. Task No. 1 [as part of the base order] – performance of the work consisting of the Implementation, resulting in the creation and launch of a functional SODiR 3.0 Funding and Reimbursement Support System meeting the requirements described in the PPU, including the OPZ. Task No. 1 is divided into the following Stages: 4.1.1.1. Stage 1 – Functional analysis of the SODiR 3.0 System; 4.1.1.2. Stage 2 – Construction of the SODiR 3.0 System. Task No. 2 – provision of Technical Support and Maintenance services for the SODiR 3.0 System to the extent and in the manner described in the PPU and OPZ, as part of the base order and under the Option. 4.1.3. Task No. 3 – provision of modifications and development for the SODiR 3.0 System within a maximum limit of 60,000 man-hours. Task No. 3 shall be executed under the Option; hereinafter referred to as the "Subject of the Agreement" or "Subject of the Order". 4.1.4. As part of the performance of the Subject Matter of the Contract, the Contractor also undertakes to: 4.1.4.1. grant the Contracting Authority a warranty and statutory warranty under the terms and conditions detailed in Section 12 of Appendix No. 2 to the SWZ; 4.1.4.2. transfer to the Contracting Authority the economic copyrights and derivative rights to the Works created or delivered during the performance of the Contract, under the terms and conditions detailed in Section 18 of Appendix No. 2 to the SWZ; 4.1.4.3. provide the Contracting Authority with licenses to use the Works, under the terms and conditions detailed in Section 18 of Appendix No. 2 to the SWZ. 4.1.5. The detailed description of the Subject Matter of the Contract, including the ATiK, MR, and the manner of their implementation, is set out in the provisions of the Contract (Appendix No. 2 to the SWZ), particularly the Detailed Description of the Subject Matter of the Contract (Appendix No. 1 to the Contract) together with its appendices. 4.1.6. For the avoidance of doubt, the Parties confirm that, regarding the Implementation, the Contracting Authority’s interest shall be satisfied solely through the delivery of a complete, fully functional SODIR 3.0 System together with the Post-Implementation Documentation—constituting a specific work—and only in such an event shall the Contract be deemed duly performed with respect to the Implementation. 4.1.7. Details concerning the Option are set out in the Proposed Contract Provisions to be incorporated into the public procurement contract (hereinafter referred to as "PPU"). 4.2. The Contracting Authority requires the Contractor or Subcontractor to employ, under an employment contract, the person(s) performing tasks related to routine administrative support—specifically, receiving and logging correspondence and managing meeting schedules—where such tasks constitute work performed in the manner defined in Art. 22 § 1 of the Act of 26 June 1974 – Labour Code (this obligation does not apply where such work is performed independently and personally by natural persons conducting business activity—i.e., self-employed individuals—acting as Subcontractors).
