The Uniwersytet Opolski in Poland from Europe region has released this tender for I. The subject of the contract is: Reconstruction of the Main Library building and the Institute of History of the University of Opole. 1. The description of the subject of the contract is included in Appendix No. 1A to the Specifications of Contracts (file folder). 2.1 The Ordering Party allows for an on-site inspection of the Library building in order to familiarize itself with the site of execution of the subject of the contract. 2.2 This inspection is not mandatory and the provisions of Article 226 paragraph 1 item 18 of the Act will not apply. 2.3 Detailed information regarding the on-site inspection can be found in Chapter I item 3.2.7 of the Specifications of Contracts II. Other information 1. The Ordering Party does not allow the submission of partial offers. 2. The Ordering Party does not allow the submission of variant offers. 3. Pursuant to Article 95 of the Act, the Ordering Party requires that the Contractor or Subcontractor employs persons performing the following activities related to the execution of the order, the performance of which involves performing work. The type of activities related to the execution of the order, which are subject to the requirements of employment based on an employment relationship by the Contractor or Subcontractor of persons performing activities during the execution of the order: general construction works. The method of verification of the employment of these persons by the Ordering Party and the Ordering Partys rights to control the Contractors compliance with the requirements related to the employment of these persons and sanctions for failure to meet these requirements have been specified by the Ordering Party in the draft contract constituting Annex No. 3 to the Technical Specifications. 4. The Ordering Party does not envisage the possibility of awarding contracts referred to in Art. 214 sec. 1 items 7 and 8 of the Public Procurement Law. 5. Requirements regarding the security for the proper performance of the contract 5.1. The Ordering Party will demanded from the contractor a performance bond in the amount of 5% of the total price specified in the offer, which serves to cover claims for non-performance or improper performance of the contract. 5.2. The contractor will propose the form of providing the security: in cash, bank guarantees or guarantees from a cooperative savings and credit union, provided that the unions obligation is always a monetary obligation, bank guarantees, insurance guarantees, guarantees granted by entities referred to in art. 6b sec. 5 item 2 of the Act of 9 November 2000 on the establishment of the Polish Agency for Entrepreneurship. Guarantees must be unconditional. 5.3. The security may be provided in one or more forms. 5.4. Seventy [70]% of the security will be returned within 30 days from the date of execution of the order and recognition by the Ordering Party as duly performed, and thirty [30]% will be returned within 15 days after the expiry of the warranty period for defects or warranty.performed, and thirty [30]% percent will be refunded within 15 days after the expiry of the warranty period for defects or guarantee. 5.5.The security deposit must be provided no later than the date the contract is concluded.
