The Contractor is obliged to comply with the provisions of the law during the performance of the contract, in particular such as: • Act of September 13, 1996 on maintaining cleanliness and order in municipalities (consolidated text: Journal of Laws of 2025, item 733, as amended), • Act of December 14, 2012 on waste (consolidated text: Journal of Laws of 2023, item 1587, as amended), • Act of 27 April 2001 - Environmental Protection Law (consolidated text: Journal of Laws of 2025, item 647), • Act of 6 March 2018 - Entrepreneurs' Law (consolidated text: Journal of Laws of 2025, item 1480, as amended), • Act of 11 September 2015 on Waste Electrical and Electronic Equipment (Journal of Laws of 2024, item 573), • Act of 24 April 2009 on Batteries and Accumulators (Journal of Laws of 2025, item 809), • Regulation of the Minister of the Environment of 11 January 2013 on detailed requirements for the collection of municipal waste from property owners (Journal of Laws of 2013, item 122), • Regulation of the Minister of Climate and Environment of 3 August 2021 on the method of calculating the levels of preparation for reuse and recycling of municipal waste (Journal of Laws of 2021, item 1530), • Regulation of the Minister of the Environment of December 15, 2017 on the levels of limiting the landfilling of biodegradable municipal waste (Journal of Laws of 2017, item 2412), • Regulation of the Minister of Climate of January 2, 2020 on the waste catalogue (Journal of Laws of 2020, item 10), • Regulation of the Minister of the Environment of June 16, 2009 on occupational health and safety in municipal waste management (Journal of Laws of 2009 No. 104 item 868), • Waste Management Plan for the Silesian Voivodeship — Resolution No. VII/6/8/2024 of October 21, 2024. The Silesian Voivodeship Assembly on the adoption of the Waste Management Plan for the Silesian Voivodeship for the years 2023-2028. And also: • Resolution No. XXVI/198/20 of the Lipowa Commune Council of 30 September 2020 on the Regulations for maintaining cleanliness and order in the Lipowa Commune, as amended, • Resolution No. XXVI/199/20 of the Lipowa Commune Council of 30 September 2020 on determining the detailed method and scope of providing services in the field of municipal waste collection from property owners and management of this waste in exchange for a fee for municipal waste management, as amended,The Contractor is obligated to monitor any changes in the above-mentioned regulations and any newly introduced ones and apply them on an ongoing basis. 2. The scope of the contract includes: 1) Collection and management of municipal waste from residential properties; 2) Collection and management of municipal waste from properties containing a summer cottage or other properties used for recreational and leisure purposes; 3) Equipping residential properties, summer cottages, and other properties used for recreational and leisure purposes with containers for collecting ash, unsorted (mixed) waste, and bio-waste; 4) Organization and operation of a Municipal Waste Selective Collection Point (PSZOK). 3. A detailed description of the subject matter of the contract is included in Appendix 2 to the Technical Specifications. 4. The estimated quantities indicated in the offer and price form, in Appendix 1 and 1a to the Technical Specifications are indicative, determined on the basis of the contract implemented in 2025. and as the anticipated demand for the services covered by the contract during the contract execution period. These quantities will be used for pricing, comparing offers, and selecting the most advantageous offer. However, the Ordering Party may fulfill the order in accordance with current demand, and the Contractor shall not be entitled to claim the services in the quantities specified in the tender form. with tender notice no. 689846-2026 published on 07 Oct 2026.
