The Popielów Commune in Poland from Europe region has released this tender for 4.1. Subject of the contract includes: The subject of the contract is the provision of services for the task entitled: “Collection and management of municipal waste from the area of ​​the Popielów commune”. including: 1. Collection and management of municipal waste from property owners where residents reside in the Popielów commune; 2. Collection and management of municipal waste from the Selective Municipal Waste Collection Point; 3. Collection and management of waste from municipal areas and Recycling Centers. In accordance with art. 91 sec. 1 of the Public Procurement Act, the Ordering Party allows the submission of partial bids divided into 3 parts, as follows: 4.1.1. Part I of the contract – Collection and management of municipal waste from property owners where residents reside in the Popielów commune; 4.1.2. Part II of the contract – Collection and management of municipal waste from the Selective Municipal Waste Collection Point. 4.1.3. Part III of the contract – Collection and management of waste from municipal areas and Recycling Centres. 4.2. A detailed description of the subject of the contract for parts 1, 2 and 3 is set out in Appendix No. 1 to the ToR “Detailed description of the subject of the contract”. 1. This public procurement procedure is conducted in accordance with the provisions of the Act of 11 September 2019 – Public Procurement Law, in an open tendering procedure (art. 129 sec. 1 item 1 of the Public Procurement Act). 2. The Ordering Party hereby informs that pursuant to art. 139 sec. 1 of the Public Procurement Act, it may first examine and evaluate the offers, and then subjectively qualify the Contractor whose offer was rated the highest, in terms of the absence of grounds for exclusion and meeting the conditions for participation in the procedure. 3. Pursuant to art. 95 sec. 1 of the Act, specifies the obligation for the Contractor or subcontractor to employ, under an employment contract, persons performing the following activities within the scope of contract performance: driving vehicles, operating vehicles – assisting with waste loading. This obligation does not apply to situations where these works are performed independently and personally by individuals conducting business activity in the form of so-called self-employment, as subcontractors. Detailed information on the manner of documenting the employment of the above-mentioned persons, the Ordering Partys rights to verify the Contractors compliance with the requirements referred to in Art. 95 sec. 1 of the Act and sanctions for failure to meet these requirements, the type of activities necessary to perform the contract, which are covered by the requirements of employment under an employment contract by the Contractor or subcontractor of persons performing activities during contract performance, are contained in the Draft Agreements (Appendix No. 2A, 2B and 2C to the SWZ). 4.1.
