The Ordering Party reserves the right to limit the amount of waste specified for each lot to indicative quantities and subject to change. The Ordering Party guarantees a minimum amount of waste of 2,000 Mg for each lot of the order. 5. The Contractor will manage the waste in accordance with applicable legal provisions. 6. The waste covered by this order must be transported and then managed in facilities that have decisions permitting the processing of this waste, in a manner consistent with applicable legal provisions. 7. Waste collection will take place via transport arranged by the contractor and at its expense, including the costs of transportation and insurance for the duration of transportation and unloading. 8. Upon the contracting authority's release of waste to the contractor, all benefits and burdens associated with it, as well as the risk of accidental loss or damage, are transferred to the contractor. 9. A detailed description of the subject matter of the contract is provided in Appendix 8 to the ToR. 10. This contract must be performed in accordance with applicable regulations and the terms and conditions contained in the ToR. 11. The Contracting Authority does not require: - the Contractor to conduct an on-site inspection, or - the Contractor to verify the documents necessary for the execution of the contract available on-site at the Contracting Authority's premises. 12. Article 95, section 1 of the Public Procurement Law, regarding the employment of employees performing services under employment contracts, does not apply to this procedure, as the service is performed at a location beyond the Contracting Authority's control. The lack of access prevents real control over the manner in which the required method of execution is performed by the employed persons. The service will be performed at a single waste management facility located away from the Ordering Party's headquarters. These facilities are typically closed to third parties for health and safety reasons. 13.
