Complex delivery of natural gas for collection points in "Uzdrowisko Rymanów" S.A. – case number DMC-03/26

The Rymanów SA Spa in Poland from Europe region has released this tender for 1) The subject of this contract is the comprehensive supply (sale and distribution) of high-methane type E natural gas for the needs of Uzdrowisko Rymanów SA in Rymanów-Zdrój in the period from January 1, 2027, to December 31, 2027. The estimated planned quantity of gas to be purchased is 5,882,776.00 kWh. A detailed description of the subject of the contract is attached as Appendix No. 1 to the Technical Specifications (SWZ), along with the annexes to the DSC. The annex summarizes data regarding consumption points in current tariff groups, contracted capacity, and forecasted consumption. 2) The data provided in Appendix No. 1 to the Technical Specifications constitutes a gas consumption forecast and is used solely for comparison of submitted offers, but under no circumstances does it constitute a commitment on the part of the Ordering Party to purchase gas in the quantities specified in the annex. 3) During the term of the contract, the Contractor will supply gas fuel in quantities corresponding to the Ordering Partys actual demand, regardless of the estimated consumption forecast over the next 12 months. 4) The Contractor will be obliged to ensure the quality parameters of the gas fuel, the quality standards of service provided to the Ordering Party and the procedure for handling complaints in accordance with the provisions of energy law applicable in this respect, in particular Chapter 8 of the Regulation of the Minister of Economy of 2 July 2010 on detailed conditions for the operation of the gas system (i.e. Journal of Laws of 2018, item 1158, as amended). 5) The delivery of gas fuel will take place on the basis of an agreement containing the provisions of the sales agreement and the agreement on the declaration of gas distribution services, in accordance with applicable law, in particular in accordance with the Act of 10 April 1997. Energy Law (Journal of Laws of 2022, item 1385, as amended) 6) The Contractor is obliged to perform all actions and arrangements with the Distribution System Operator (DSO) necessary to carry out the supplier change procedure, and the Ordering Party informs that it is currently carrying out a comprehensive supply of gaseous fuel under an agreement concluded for a fixed term, i.e. until 31 December 2026. 7) The Ordering Partys facilities are subordinated to the Tarnów Branch of Polska Spółka Gazownictwa sp. z o.o. 8) The Contractor is obliged to keep the Ordering Party informed about the performed contractual capacity on an ongoing basis. If this information cannot be included on the invoice, it may be presented as an appendix to the invoice. 9) The Ordering Party is partially exempt from excise duty under art. 31b sec. 2 of the Act of 6 December 2008 on Excise Duty (Journal of Laws of 2022, item 143). In Annex 1.2, the Ordering Party presents the recipients declaration on the intended use of gas fuel for the purposes of calculating excise duty, which is an annex to the currently implemented comprehensive contract for the supply of gas fuel - 2 pcs. including PPG exempt from excise duty and with the established excise duty rate. 10) The Ordering Party declares,that the consumption points of the organizational units indicated in the list, Annex No. 2a to the SWZ are subject to tariff protection contained in the Act of 26 January 2022 on special solutions for the protection of gas fuel recipients in connection with the situation on the gas market (Journal of Laws of 2022, item 202). In Annex 1.1, the Ordering Party presents a declaration of the gas fuel recipient on the intended use of the gas fuel referred to in Art. 62bb section 1 of the Energy Law Act, which is an annex to the currently implemented comprehensive agreement for the supply of gas fuel. Exclusion of the Contractor in connection with counteracting aggression against Ukraine (mandatory exclusion). The Contractor is excluded from the contract award procedure if: 1) he is listed in the lists specified in Regulation No. 765/2006 and Regulation No. 269/2014 or entered on the list on the basis of a decision on entry on the list deciding on the application of the measure referred to in Art. 1 point 3 of the Act on special solutions for counteracting support for aggression against Ukraine and serving to protect national security (Journal of Laws of 2023, item 1497) hereinafter referred to as the Act on Special Solutions 2) whose beneficial owner within the meaning of the Act of 1 March 2018 on counteracting money laundering and terrorist financing (Journal of Laws of 2022, items 593, 655 and 835) is a person included in the lists specified in Regulation No. 765/2006 and Regulation No. 269/2014 or entered on the list or being such a beneficial owner from 24 February 2022, provided that he or she was entered on the list on the basis of a decision on entry on the list deciding on the application of the measure referred to in Art. 1 point 3 of the Act on Special Solutions, 3) whose parent entity within the meaning of Art. 3 sec. 1 point 37 of the Act of 29 September 1994 on Accounting (consolidated text: Journal of Laws of 2023, item 120, as amended) is an entity listed in the lists specified in Regulation No. 765/2006 and Regulation No. 269/2014 or entered on the list or being such a parent entity from 24 February 2022, provided that it was entered on the list on the basis of a decision on entry on the list deciding on the application of the measure referred to in Art. 1 point 3 of the Act on special solutions - exclusion takes place for the duration of the circumstances specified in points 1) – 2) 4) on the basis of Art. 5k of Regulation No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russias actions destabilising the situation in Ukraine - including subcontractors, suppliers or entities on whose capacities are relied upon within the meaning of the Public Procurement Directives, where they account for more than 10% of the contract value.1 The Contracting Authority shall submit a declaration from the recipient of gas fuels on the intended use of the gas fuel referred to in Article 62bb section 1 of the Energy Law, which is an annex to the currently implemented comprehensive agreement for the supply of gas fuel.
