Comprehensive collection and management of municipal waste from properties in the Brzeszcze Commune, including the operation of the Municipal Waste Management System (PSZOK) in the Brzeszcze Commune

The GMINA BRZESZCZE in Poland from Europe region has released this tender for 1. The subject of the contract is the comprehensive provision of services including the collection, transport, and management (recovery or disposal) of specified fractions of municipal waste from property owners residing within the administrative boundaries of the Brzeszcze Commune, as well as the organization, maintenance, and ongoing operational support of a stationary Municipal Waste Selective Collection Point (PSZOK) located within the commune. A detailed description of the subject of the contract is provided in Appendix No. 13 – Description of the Subject of the Contract, and Appendix No. 12 – contract template to the Technical Specifications. 2. PROTECTION OF PERSONAL DATA COLLECTED BY THE CONTRACTING PARTY DURING THE PROCEDURE – information is described in detail in the Technical Specifications, p. 3. 3. The Contractor will not be required to provide a performance security prior to entering into the contract. 4. The Contracting Authority does not require the submission of the evidence in question with the offer. 5. CONTRACTORS JOINTLY COMPETING FOR A PUBLIC CONTRACT. 1) Contractors jointly applying for a contract (consortium, civil partnerships) will be jointly and severally liable for non-performance or improper performance of an obligation arising from the subject of the awarded contract; 2) The same Contractor may be a member of only one consortium. 3) Contractors may jointly apply for a public contract. In such a case, Contractors applying jointly are obliged to appoint a proxy to represent them in the procedure or to represent them in the procedure and conclude an agreement regarding the public contract in question. All correspondence by the Ordering Party will be conducted exclusively with the proxy. 4) The condition regarding the authorization to conduct a specific business or professional activity (if formulated), referred to in Art. 112, sec. 2 point 2 of the Public Procurement Law, will be met if at least one of the contractors jointly applying for the contract has authorizations to conduct specific business or professional activities and will perform the services for which these authorizations are required. 5) With respect to the conditions regarding education, professional qualifications or experience (if formulated), contractors jointly applying for the contract may rely on the capabilities of those contractors who will perform the services for which these capabilities are required. 6) In the case referred to in par. 4) and 5), contractors jointly applying for the contract shall attach to their offer a declaration specifying which services will be performed by individual contractors. 6. GROUNDS FOR EXCLUSION. The Contracting Authority will exclude from the procedure Contractors for whom there are grounds for exclusion: - referred to in art. 108 sec. 1 of the Public Procurement Law, - for whom there are grounds for exclusion referred to in art. 7 sec. 1 of the Act of 13 April 2022.on specific arrangements to counteract support for aggression against Ukraine and to protect national security, - in respect of which there are grounds for exclusion referred to in Article 5k) of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russias actions destabilizing the situation in Ukraine (OJ EU No L 229, 31.7.2014, p. 1), hereinafter referred to as: Regulation 833/2014, as amended by Council Regulation (EU) 2025/2033 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russias actions destabilizing the situation in Ukraine (OJ L 2025/2033, 23.10.2025). with tender notice no. 714822-2026 published on 15 Oct 2026.
