Energy Law (consolidated text: Journal of Laws of 2026, item 43, as amended), implementing provisions to this Act, in particular the Regulation of the Minister of Climate and Environment of 12 June 2025 on detailed conditions for the operation of the power system (consolidated text: Journal of Laws of 2025, item 919), the currently applicable tariff for electricity distribution services of the relevant Distribution System Operator (DSO) approved by the President of the Energy Regulatory Office, the Instructions for Operation and Maintenance of the Distribution Grid, generally applicable legal provisions, and unit prices of active energy determined after the resolution of the proceedings in question. 4. Conditions regarding the execution of the order are specified in the Draft provisions of the agreement constituting Appendix No. 6 to the SWZ. 5. The unit offer price of active energy for a given tariff will result from the Assortment and Pricing Form constituting Appendix No. 1 to the SWZ/Appendix No. 2 to the Draft provisions of the agreement. 6. The location, technical data of the electricity consumption points, and planned electricity consumption for the period from January 1, 2027 to December 31, 2027 are included in Appendix No. 3 to the Technical Specifications. This demand was determined based on electricity consumption in 2026 and projected consumption estimates for 2027. It is indicative only, used for comparison of offers, and does not constitute an obligation on the part of the Ordering Party to purchase energy in the specified amount. The potential Contractor shall not be entitled to any claim against the Ordering Party for failure to consume the expected amount of energy. 7. The Ordering Party has the right to register a new electricity consumption point, but increasing the number of consumption points or changing the tariff group is only possible within the tariff groups included and priced in the Assortment and Price Form. Registering a new EPP requires an annex to the contract. 8. The Ordering Party has the right to withdraw from the EPP due to, for example, a change in the location (address) of the Regional Water Management Authority (RZGW) or its organizational unit, and therefore the EPP. 9. The Ordering Party requires that billing for consumed energy take place in the billing periods used by the DSO, according to actual consumption, with the due date of invoices for supplied electricity and distribution services specified as 30 days from the date of issue of the document. 10. Under the comprehensive agreement, the Contractor should be designated as the entity responsible for commercial balancing, i.e.covering losses resulting from the difference in forecasted energy consumption compared to actual energy consumption in a given billing period, and preparing and reporting electricity demand schedules to the Distribution System Operator and the Transmission System Operator. 11. The Ordering Party does not allow the submission of partial bids. 12. The Ordering Party does not divide the project into lots for the following reasons: The Ordering Party does not envisage submitting partial bids for individual PPEs: 1) for organizational reasons (all consumption points are located in one electricity distribution area), 2) for fear that if bids for individual facilities were allowed, especially in relation to unattractive consumption points, the Ordering Party will not receive bids. 13. The Ordering Party does not allow the submission of variant bids. 14. The Ordering Party does not envisage the possibility of awarding contracts referred to in art. 214 sec. 1 item 8 of the Public Procurement Act. 15. CPV: 09310000-5 and 65310000-9. 16. The Ordering Party does not reserve the obligation for the Contractor to personally perform key tasks related to the contract. 17. Rules regarding subcontracting: 17.1 The Ordering Party allows the participation of subcontractors in the performance of the contract. 17.2 If subcontractors participate in the performance of the contract, the Ordering Party, in accordance with art. 462 sec. 2 of the Public Procurement Act, requests that the Contractor indicate in the offer the parts of the contract which it intends to entrust to subcontractors, and that the Contractor provide the names of the subcontractors, if already known. 17.3 Entrusting the performance of part of the contract to subcontractors does not release the Contractor from liability for the proper performance of the contract. 18. The Ordering Party does not envisage the possibility of exercising the option right referred to in art. 441 of the Public Procurement Act. 19. The Ordering Party, in accordance with art. 95 sec. 1 of the Public Procurement Act, does not specify activities related to the performance of the contract to which the requirements for the employment by the Contractor or subcontractor of persons performing activities during the performance of the contract on the basis of an employment relationship apply. 20. The Ordering Party does not impose requirements regarding the employment by the Contractor of persons referred to in art. 96 sec. 2 item 2 of the Public Procurement Act. 21. The Ordering Party does not allow the conclusion of a framework agreement. 22. The Ordering Party does not envisage selecting the most advantageous offer using an electronic auction. 23. The Ordering Party does not envisage submitting offers in the form of electronic catalogues. 24. All costs associated with participation in the proceedings, in particular the preparation and submission of the offer, will be borne by the Contractor submitting the offer. The Ordering Party does not envisage reimbursement of costs of participation in the proceedings. 25. The Ordering Party hereby informs that the estimated value of the contract in question is PLN 657,846.71 net. 26. The Ordering Party reserves the right to cancel this proceedings pursuant to Art. 257 of the Public Procurement Act - in accordance with the provisions of the Specification of Technical Specifications. with tender notice no. 681428-2026 published on 07 Oct 2026.
