The subject of the contract (under the basic contract) is the provision by the Contractor to the Contracting Authority of comprehensive, constant, 24-hour physical security of persons and property within the "EC1 Łódź – City of Culture" complex in Łódź, which consists of the following elements: 1) security of facilities and grounds; 2) security of exhibitions; 3) cash escorting; 4) cloakroom service; 5) intervention group support. 2. The detailed scope and subject of the contract and the Contracting Authoritys requirements regarding the method of implementation are specified in: 1) Detailed description of the subject of the contract (hereinafter also "SOPZ") – Appendix No. 1 to the Technical Specifications, 2) Draft contract provisions (hereinafter also "PPU") – Appendix No. 2 to the Technical Specifications. All requirements specified in the procedure documents (including those indicated above) constitute minimum requirements, and their compliance is mandatory. Failure to meet the aforementioned minimum requirements will result in rejection of the offer as non-compliant with the terms of the contract pursuant to Article 226 section 1 item 5 of the Public Procurement Act. 3. Due to the nature of the facility being protected, the Contractor will be obligated to perform the subject of the contract with the participation of security personnel covering all shifts, possessing the psychophysical predispositions and ability to perform assigned duties, in particular intervention activities, responding to hazardous situations, and implementing alarm and evacuation procedures, appropriate to the specific nature of the facility. 4. The Ordering Party does not reserve the obligation for the Contractor to personally perform key tasks related to service contracts. 5. The Contractor is obligated to perform the subject of the basic contract and the optional contract from November 10, 2026, from 7:00 AM to November 10, 2027, at 7:00 AM; Justification: The specification of the contract completion date by indicating specific daily dates results from objective reasons related to the nature and specificity of the subject of the contract. Due to the nature of the protected facilities and the need to ensure the safety of persons and property, the service must be provided continuously, without the possibility of interruptions between subsequent contracts. The contract commencement date – November 10, 2026, 7:00 AM – corresponds to the completion date of the current contract, which allows for the direct assumption of obligations by the contractor selected in this procedure. For the same reasons, the Ordering Party has set the contract completion date as November 10, 2027, 7:00 AM. This date constitutes a fixed cut-off date for the security services cycle adopted by the Ordering Party. In the event of an extension of the procedure and the conclusion of the contract after the planned commencement date of the provision of services referred to in paragraph 5, the implementation of the subject matter of the contract will begin on the day following its conclusion, while the completion date will remain unchanged. The above circumstances,resulting from the continuous and 24-hour nature of the service and the need to ensure uninterrupted protection of persons and property, constitute an objective reason justifying the determination of the order completion date by indicating daily dates, in accordance with Art. 436 item 1 of the Public Procurement Law. 2) The Ordering Party will be entitled to exercise the option right throughout the entire period indicated in paragraph 5, to the extent specified in the DDOC, which will take place each time by submitting an appropriate declaration of intent by the Ordering Party, and such declaration will be able to be submitted by the Ordering Party each time no later than 48 hours before the start of the planned cultural event. with tender notice no. 707109-2026 published on 13 Oct 2026.
