The scope of the contract, to be performed by the Contractor, includes in particular: - developing the concept; - developing design and cost estimate documentation; - developing detailed construction documentation; - carrying out all activities to obtain appropriate permits and decisions; - performing authorial supervision; - carrying out construction works in accordance with the documentation developed and approved by the Client. 3.2. As part of authorial supervision, the Contractor's designer is obligated to: - monitoring the compliance of technical, material, and utility solutions with the design and cost estimate documentation during construction works, - supplementing the details of the design and cost estimate documentation and clarifying any doubts arising during construction works to the construction contractor's construction manager, - agreeing with the Ordering Party and the construction manager on the possibility of introducing alternative solutions to the materials and equipment specified in the design documentation, - ensuring that the scope of introduced changes does not result in a significant change to the approved construction design, - participating in technical meetings, - participating in partial and final acceptances, - accepting all changes, including insignificant ones, arising during the implementation of the investment, - assessing the test results of construction materials and components, - issuing an opinion on the compliance of the parameters of materials or equipment proposed by the Contractor or construction bidder with the design solutions, - participating in commissioning or activities aimed at achieving the designed functional capacity. 3.3. The detailed scope and requirements for the design and cost estimate documentation and the planned construction works are specified in the Functional-Utility Program and its annexes (Annex No. 1 to the ToR). 4. The offer validity period expires on January 11, 2026. 5. The GDPR information clause is included in Chapter I of the ToR. 6. The Ordering Party anticipates applying the procedure referred to in Article 139 of the Public Procurement Law, the so-called "reverse procedure," i.e. the Ordering Party may first examine and evaluate the offers, and then subjectively qualify the contractor whose offer was rated the highest, in terms of the absence of grounds for exclusion and meeting the conditions for participation in the procedure. 7. The Ordering Party anticipates granting advance payments towards contract performance according to the principles specified in § 8 of the draft contract provisions. 8. The Ordering Party requires a deposit of PLN 500,000.00 9. The Ordering Party requires a security for the proper performance of the contract 10. The Ordering Party allows for the possibility of amending the concluded contract in relation to the content of the selected offer within the scope regulated in art. 454-455 of the Public Procurement Law and indicated in § 6 sec. § 9 PPU and § 25 PPU Reliance on Resources of Other Entities 1. In order to confirm compliance with the conditions for participation in the procedure, in appropriate situations and with respect to a specific contract or part thereof, the Contractor may rely on the technical or professional capabilities or the financial or economic standing of entities providing resources, regardless of the legal nature of the legal relationship between it and them. 2. With respect to conditions concerning education, professional qualifications or experience, contractors may rely on the capabilities of entities providing resources if these entities will perform works or services for which these capabilities are required. 3. A contractor that relies on the capabilities or standing of entities providing resources shall submit, together with its bid, a commitment from the entity providing resources to provide the necessary resources to perform the given contract (Appendix No. 6 to the Specification of Technical Terms of Reference) or other subjective evidence confirming that the Contractor will have the necessary resources of these entities at its disposal when performing the contract. 4. The commitment of the entity providing resources, referred to in point 3 above, confirms that the relationship between the Contractor and the entities providing resources guarantees actual access to these resources and specifies in particular: 1) the scope of the resources of the entity providing resources available to the Contractor; 2) the method and period of making the resources of the entity providing these resources available to the Contractor and its use in performing the contract; 3) whether and to what extent the entity providing resources, on whose capabilities the Contractor relies with respect to the conditions of participation in the procedure concerning education, professional qualifications or experience, will perform the construction works or services to which the indicated capabilities relate. 5. The Ordering Party assesses whether the technical or professional capabilities or financial or economic situation made available to the Contractor by the entities providing the resources allow the Contractor to demonstrate compliance with the conditions for participation in the procedure, and also examines whether there are no grounds for exclusion in relation to this entity, which have been provided for the Contractor - the JEDZ declaration and the declaration from Annex No. 5 to the SWZ. with tender notice no. 658102-2026 published on 24 Sep 2026.
