The technical documentation meets the requirements for accessibility for people with disabilities and is designed for all users (universal design), in accordance with the provisions of the Building Law and implementing regulations. 4. SOURCE OF FINANCING: I. Part I: Construction of the Ostrołęka Bypass - stage II from km 4+738 to km 7+064.20. Own funds of the Ostrołęka County budget. The investment is planned for co-financing from the Government Road Development Fund; moreover, Ostrołęka County is applying for a targeted subsidy from the budget of the Mazowieckie Voivodeship and financial assistance from the Lelis commune. II. Part II: Construction of the Ostrołęka Bypass - stage III from km 3+532 to km 4+738. Own funds of the Ostrołęka County budget. Tender Description
1. The subject of the contract is: Construction of the Ostrołęka Bypass, divided into two parts. Part I: Construction of the Ostrołęka Bypass - stage II from km 4+738 to km 7+064.20 Part II: Construction of the Ostrołęka Bypass - stage III from km 3+532 to km 4+738. The performance of the contract is subject to Polish law, in particular the Act of 7 July 1994 - Building Law, the Act of 23 April 1964 - Civil Code and the Act of 11 September 2019 - Public Procurement Law. EACH PART CONSTITUTES A SEPARATE CONTRACT. The contractor may submit one offer for the execution of each of the aforementioned parts of the subject of the contract. Contracts for all lots may be awarded to a single contractor. 2. A detailed description of the subject matter of the contract is included in the design documentation, bills of quantities, and technical specifications for the execution and acceptance of the works, which constitute annexes to the Technical Specifications. 3. ACCESSIBILITY REQUIREMENTS IN THE CONTEXT OF THE ACT ON ENSURING ACCESSIBILITY FOR PERSONS WITH SPECIAL NEEDS: The Contracting Authority, as the executor of a public task, has a statutory obligation to ensure that in a public facility (and this road is one of them), guided by the principle of equal opportunity and non-discrimination in all areas, the requirements of universal design for all users, as well as the obligations arising from the Act on Ensuring Accessibility for Persons with Special Needs, are taken into account. The technical documentation meets the requirements for accessibility for people with disabilities and is designed for all users (universal design), in accordance with the provisions of the Building Law and implementing regulations. 4. SOURCE OF FINANCING: I. Part I: Construction of the Ostrołęka Bypass - stage II from km 4+738 to km 7+064.20. Own funds of the Ostrołęka County budget. The investment is planned for co-financing from the Government Road Development Fund; moreover, Ostrołęka County is applying for a targeted subsidy from the budget of the Mazowieckie Voivodeship and financial assistance from the Lelis commune. II. Part II: Construction of the Ostrołęka Bypass - stage III from km 3+532 to km 4+738. Own funds of the Ostrołęka County budget. Ostrołęka County is applying for a targeted subsidy from the budget of the Mazowieckie Voivodeship and financial assistance from the Lelis commune. III. The Ordering Party anticipates the possibility of canceling the public procurement procedure on the basis of Art. 257 of the Public Procurement Law, if the public funds that the Contracting Authority intended to allocate to finance all or part of the contract are not granted to it. 5. The Contracting Authority does not envisage an electronic auction. 6. The Contracting Authority does not allow the submission of variant offers or offers in the form of electronic catalogues. 7. The Contracting Authority does not conduct proceedings aimed at concluding a framework agreement. 8. The Contracting Authority does not reserve the right to apply for the contract only to Contractors referred to in Art. 94 of the Public Procurement Law. 9. The Contracting Authority does not specify additional requirements related to the employment of persons referred to in Art. 96 sec.2 point 2 of the Public Procurement Act. 10. The Ordering Party does not require the evidence in question in this procedure. 11. WARRANTY PERIOD AND WARRANTY FOR DEFECTS: The Ordering Party requires the Contractor to provide a quality guarantee for the performed works for a period of at least 60 months, counting from the date of signing the final acceptance protocol. The warranty period is equal to the warranty period. The warranty and warranty period for defects is one of the criteria for offer evaluation (applies to each part of the procedure). 12. The Ordering Party informs that the submission of an offer does not have to be preceded by an on-site visit or inspection of the documents related to the order held by the Ordering Party. The Ordering Party recommends conducting an on-site visit at the place of execution of the subject of the order. The on-site visit is optional and may take place at any time before the deadline for submission of offers, without the Ordering Party's participation. 15. The Contractor may entrust the execution of part of the order to a subcontractor (subcontractors). The Ordering Party does not reserve the obligation for the Contractor to personally perform key parts of the order. All costs associated with participation in the proceedings, in particular the preparation and submission of the offer, will be borne by the Contractor submitting the offer.
