The scope of the subject of the contract also includes. 1) surveying services to the extent necessary to perform the subject of the contract, 2) preparation of as-built surveying documentation, 3) obtaining an occupancy permit and handing over the completed facility to the Ordering Party for use, along with documentation containing approvals, certificates, or certificates necessary to commence operation, 4) and all elements listed in any part of the studies comprising Appendix No. 1 to this Specification of Procurement Conditions (TSC) that affect the bid price of the subject of the contract. 4. The Ordering Party does not have a water permit. The Contractor will be responsible for preparing all documentation permitting the launch of the intake and water collection. 5. The Ordering Party anticipates the possibility of replacement works and the conditions under which such changes may be introduced for technological and economic reasons, if the introduction of replacement works is necessary for the proper performance of the contract and does not result in the expansion of the subject of the contract in relation to the subject specified in the TSC and resulting from the content of the TSC. The conditions regarding the scope of replacement works and the method of their settlement are described in § 15 of the contract template. The Ordering Party will inform the Contractor of any changes during the performance of the contract. Carrying out alternative works requires an amendment to the contract in the form of an annex to the contract, as specified in Art. 455 of the Public Procurement Act. 6. Due to the award of the contract for the design and construction of a treated water reservoir at the Święcice Water Treatment Plant, the performance of the works will require coordination of construction activities with another Contractor. 7. When executing the contract, the Contractor is obligated to ensure – to the extent appropriate to the subject matter of the contract and its characteristics – accessibility (architectural, digital, and information and communication) for people with special needs, at least to the extent specified by the minimum requirements referred to in Art. 6 of the Act of 19 July 2019 on ensuring accessibility for people with special needs (Journal of Laws of 2024, item 1411, as amended). 8.Pursuant to Art. 95 of the Public Procurement Law, the Ordering Party requires that the Contractor or Subcontractor employ, under an employment contract, persons performing activities indicated by the Ordering Party within the scope of the contract, if the performance of such activities involves performing work in the manner specified in Art. 22 § 1 of the Act of 26 June 1974 – the Labor Code (Journal of Laws of 2025, item 277, as amended). The requirement for employment by the Contractor or Subcontractor under an employment contract applies to persons performing construction works directly on the construction site, i.e. manual workers and lower-level technical employees responsible for the organization and implementation of construction works. These requirements do not apply to construction managers, works managers and persons providing services on the construction site as part of their own business activity using their own equipment or tools, such as measurement and testing works, demolition and earthworks, and the delivery of excavated material or transport of construction materials, etc. The method of employment verification, as well as the Ordering Partys rights to control the Contractors compliance with employment-related requirements and sanctions for failure to meet these requirements are indicated in the contract template, which constitutes Annex No. 2 to the SWZ. with tender notice no. 696270-2026 published on 09 Oct 2026.
