The detailed scope of the subject of the contract and the description of the Ordering Party's requirements for implementation and acceptance are specified in: Annex No. 5 to the Technical Specifications (SWZ) with Annex No. 1, and Annex No. 3 to the SWZ. 6. The Ordering Party requires that the tender offer be accompanied by evidence confirming that the tendered subject of the contract complies with the Ordering Party's requirements specified in the description of the subject of the contract, as specified in Annex No. 5 to the Technical Specifications (SWZ). 7. The Ordering Party allows for the supplementation of the tender offer if the Contractor fails to submit it or if the tender offer is incomplete. Supplementation will not be required if, despite the submission of the tender offer, the tender offer is subject to rejection or if there are grounds for invalidating the tender. The Ordering Party may request explanations from contractors regarding the content of the tender offer. 8. The Ordering Party will not request submission and/or supplementation if the evidence in question serves to confirm compliance with the features or criteria specified in the description of the offer evaluation criteria or, despite the submission of the evidence in question, the offer is subject to rejection or there are grounds for invalidating the procedure. 9. In cases where: 1) the subject of the contract is described in the procedure documentation using standards, approvals, technical specifications and reference systems referred to in art. 101 sec. 1 item 2 and sec. 3 of the Act, 2) the procedure documentation refers to devices, software or systems or products with the indication of trademarks, patents, proper names, origin, source or a specific process that characterizes products or services supplied by a specific manufacturer or supplier - it is assumed that such indications are accompanied by the words "or equivalent". These designations serve solely to describe the minimum technical, operational and functional parameters that should be met by the subject of the contract. The ordering party will consider devices, systems and other equipment covering the subject of the order with technical and operational parameters that are not worse than those mentioned above as equivalent solutions.functionalities than those indicated in the DSC and other procedure documents. 10. A contractor who relies on solutions equivalent to those described by the Ordering Party is obliged to demonstrate that the devices and systems they offer meet the requirements specified by the Ordering Party in Annex No. 5 to the DSC. 11. A contractor reliant on equivalent solutions is obliged to prove to the Ordering Party, in particular using the evidence referred to in Art. 104-107 of the Act, that the proposed solutions meet the requirements specified by the Ordering Party to an equivalent extent. 12. The Ordering Party requires that the delivered equipment be brand new, i.e. manufactured no earlier than 12 months before delivery, has not been used for exhibition purposes, and comes from a legal source. If any doubts arise as to the compliance of the offered equipment with the subject of the contract, in particular regarding its legality, the Ordering Party is entitled to request the manufacturer of the offered equipment to confirm its compliance with the contract (including providing the manufacturer with the necessary data enabling verification), and to commission the manufacturer of the offered equipment, or an entity designated by the manufacturer, to inspect the equipment for compliance with the contract and the validity and scope of warranty and license entitlements. 13. The offered equipment must not be designated by the manufacturer for withdrawal from production or sale on the date of submission of offers. During the warranty period, the equipment or its parts will be repaired or replaced with new, original parts, in accordance with the manufacturer's methodology and recommendations. 14. The use of equipment or systems designated as prototypes, trial series, demonstration versions, or as single-production is not permitted. 15. Equipment, systems, system software, and application software should originate from a manufacturer that provides service and warranty services consistent with the requirements described in the OPZ and PPU. 16. The Ordering Party requires that the Contractor or subcontractor employ, under an employment contract, persons performing the following activities: Project Coordinator, Data Specialist, Personal Data Protection Specialist (DPO), Designer/Programmer, Training Specialist. 17. The Ordering Party requires that the offered service, including all ICT products, ICT services and ICT processes used to perform the order, both as main elements and components, elements of the service provision environment or accompanying solutions, does not include: 1) ICT products, ICT services or ICT processes indicated in the recommendation referred to in art. 33 sec. 4 of the Act on the National Cybersecurity System (UKSC), stating their negative impact on the fundamental interest of state security, 2) an ICT product the type of which was determined in the decision on recognizing the supplier as a high-risk supplier, referred to in art. 67b sec. 15 of the UKSC, nor ICT services or ICT processesin this decision with tender notice no. 677186-2026 published on 07 Oct 2026.
