Information on the prior evaluation of offers referred to in art. 139 of the Public Procurement Act: The Ordering Party hereby informs that pursuant to art. 139 sec. 1 of the Public Procurement Act, it will first examine and evaluate the offers, and then select the Contractor whose offer was rated the highest in terms of the absence of grounds for exclusion and compliance with the conditions for participation in the procedure. 2. Together with its offer, the Contractor is obliged to submit: a) European Single Procurement Document; b) Declaration of economic operators jointly applying for the contract (if applicable); c) Commitment of the entity providing the resources (if applicable); d) Declaration of the contractor/contractors jointly applying for the contract regarding separate grounds for exclusion; e) Declaration of the entity providing the resources regarding separate grounds for exclusion; f) A document specifying the scope of authorization to act on behalf of the Contractor in the contract award procedure; g) Subject-related evidence: Product brochure/product catalog/technical specification of the offered devices confirming compliance with all parameters specified by the ordering party in the tender specification (in Polish) - the ordering party expects to supplement the subject-related evidence indicated in the above point. Before selecting the most advantageous offer, the ordering party will request the Contractor whose offer was rated the highest to submit, within a specified deadline of no less than 10 days and valid as of the date of submission, the following subject-related evidence or a certificate of the public procurement contractor replacing the relevant subject-related evidence, within a period of no less than 10 days from the date of the request. The certificate will be recognized by the ordering party only to the extent that it confirms the absence of grounds for exclusion or fulfillment of the conditions for participation in the procedure specified in this tender specification: 1) In order to confirm the Contractor's fulfillment of the conditions for participation in the procedure: a) A document confirming that the Contractor is insured against civil liability within the scope of the business conducted related to the subject matter of the contract for a guaranteed sum of not less than PLN 400 000.00 (in words: four hundred thousand zlotys); b) List of supplies and services; c) List of persons; d) Certificate or equivalent confirmations confirming the ISO 9001 and 27001 standards for at least services related to cybersecurity; 2) In order to confirm the lack of grounds for excluding the Contractor from participation in the procedure: a) Information from the National Criminal Register; b) The contractor’s declaration regarding the capital group; c) An extract or information from the National Court Register or CEIDG; d) Certificate from the Social Insurance Institution (ZUS) or the Agricultural Social Insurance Fund (KRUS); e) The contractor’s declaration that the information contained in the introductory declaration is up to date; f) A declaration from the entity providing the resources that the information contained in the introductory declaration is up to date. Instead of the relevant documents indicated in this table, the Contractor may submit a certificate confirming non-exclusion if the certificate covers the relevant ground for exclusion. If the certificate does not cover all the grounds for exclusion indicated by the Ordering Party, the Contractor shall submit documents and declarations concerning the grounds not covered by the certificate. Regardless of the scope of the certificate, the Contractor shall submit declarations concerning: a) Article 5k of Council Regulation (EU) No 833/2014, b) Article 7 paragraph 1 of the Act of 13 April 2022, c) the validity of the information relating to the grounds for exclusion not covered by the certificate and to the circumstances arising in this procedure. In the case of the ground for exclusion specified in Article 109 paragraph 1 item 1 of the Public Procurement Act, the Ordering Party, regardless of the submitted certificate, may, before awarding the contract, request a current certificate from the competent head of the tax office and the competent social or health insurance authority. 3) Documents of Contractors with their registered office or place of residence outside the Republic of Poland: a) Document confirming that no liquidation of the contractor has been opened; b) Information from the relevant register or other equivalent document; c) A document confirming the absence of arrears in the payment of taxes, fees or social security or health insurance contributions. In the procurement procedure, communication between the Ordering Party and the Contractors takes place electronically using the Public Procurement Platform https://ezamowienia.gov.pl/pl/. In all correspondence related to this procedure, the Ordering Party and the Contractors use the case number assigned by the Ordering Party: ZGK.2.2026 or the announcement number (TED) or the procedure identifier generated by https://ezamowienia.gov.pl/pl/. with tender notice no. 666193-2026 published on 29 Sep 2026.
