Delivery of a database server along with implementation, technical support and warranty

The Central Information Technology Center in Poland from Europe region has released this tender for 1. The subject of the order is: 1.1. delivery to the Location and transfer of ownership to the Ordering Party of the database server referred to in point IX, table No. 1 of the OPZ - Chapter II of the SWZ; 1.2. delivery of Documentation together with providing the Licenses necessary for the proper functioning of the Device; 1.3. implementation of the Device; 1.4. preparation and delivery of as-built Documentation; 1.5. providing a Warranty for the Device referred to in point VII of the OPZ - Chapter II of the SWZ, for a period of 36 months, 1.6. providing Technical Support referred to in point VIII of the OPZ - Chapter II of the SWZ, for a period of 36 months. 2. The subject of the order is described in detail in Chapter II of the SWZ - Description of the subject of the order. 3. The Ordering Party, pursuant to Art. Article 139 of the Public Procurement Law provides for a reverse order of evaluation of offers, i.e., the Ordering Party will first examine and evaluate the offers, and then subjectively qualify the Contractor whose offer received the highest score, in terms of the absence of grounds for exclusion and meeting the conditions for participation in the procedure. 4. The Ordering Party is the controller of personal data within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016. on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, hereinafter referred to as "GDPR". 5. The Contractor submits the offer via the e-Procurement Platform of the Public Procurement Office - https://ezamowienia.gov.pl/pl/. 6. The Contracting Authority reserves the right to cancel the contract award procedure in accordance with Art. 257 of the Public Procurement Law, if the public funds that the Contracting Authority intended to allocate to finance the contract are not awarded. 7. The offer must be submitted, under pain of nullity, in electronic form, in accordance with the requirements strictly specified in the Specification of Technical Specifications. 8. The Contracting Authority will not award the contract if the circumstances referred to in Art. 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning organisational measures in connection with Russia's actions destabilising the situation in Ukraine (OJ EU L of 2014, No. 229, p. 1, as amended) and will exclude the Contractor if at least one of the grounds for exclusion specified in Art. 7 sec. 1 of the Act of 13 April 2022 occurs. on specific solutions to counteract support for aggression against Ukraine and to protect national security (consolidated text: Journal of Laws of 2025, item 514) – in order to confirm that there are no grounds for exclusion, a declaration constituting Appendix No. 5 to the Offer Form must be submitted with the offer. 9. The Order must be completed within the deadlines indicated below, i.e.: 9.1. Delivery of the Device referred to in point IX, table No. 1 of the OPZ, together with assembly and installation, within 30 days from the date of conclusion of the Agreement, which will be delivered to the Location, together with the Software and Documentation and as-built documentation, during Business Hours – completed by the signing of the Acceptance Protocol. 9.2. The delivered Device will be covered by a Warranty from the date of delivery indicated in the Acceptance Protocol signed by the parties without reservations, for a period of 36 months. 9.3. The delivered Device will be covered by Technical Support for a period of 36 months from the delivery date indicated in the Acceptance Protocol signed by the parties without reservations. The Contracting Authority requires that the subject matter of the contract, including all ICT products, ICT services and ICT processes used to perform the contract, whether as main elements, components, elements of the environment, provision of services or accompanying solutions, does not include: 10.1. ICT products, ICT services or ICT processes indicated in the recommendation referred to in art. 33 sec. 4 of the Act of 5 July 2018 on the National Cybersecurity System, stating their negative impact on the fundamental interest of state security; 10.2. ICT product the type of which was specified in the decision on recognizing the supplier as a high-risk supplier, referred to in art. 67b sec. 15 of the Act of 5 July 2018 on the National Cybersecurity System, or ICT services or ICT processes specified in that decision. Failure to meet the above requirement will result in rejection of the offer on the basis of art. 226 sec. 1 item 17 or item 19 of the Public Procurement Act, respectively. 11. The Ordering Party requests that the above-mentioned evidence be submitted together with the offer to confirm the compliance of the offered supplies with the requirements specified in Chapter II of the SWZ – Description of the Subject of the Order (in accordance with point 6 of Chapter I of the SWZ – Instructions for Contractors). with tender notice no. 653998-2026 published on 24 Sep 2026.
