The contract may be awarded to contractors who: 1) are not subject to exclusion in the circumstances referred to in art. 108 sec. 1 of the PZP Act, provided that in the Procedure, the contractor is not subject to exclusion in the case referred to in art. 108 sec. 1 item 1 letter h of the PZP Act, and in the case referred to in art. 108 sec. 1 point 2 of the PZP Act, if the person referred to in that provision has been convicted of the offence listed in Art. 108 sec. 1 point 1 letter h of the PZP Act, moreover, they are not subject to exclusion in the circumstances referred to in: - Art. 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilizing the situation in Ukraine (OJ EU L 229 of 2014 No. 229, p. 1 as amended; hereinafter "Regulation 833/2014"), - Art. 7 sec. 1 of the Act of 13 April 2022 on special solutions for counteracting support for aggression against Ukraine and serving to protect national security (i.e. Journal of Laws of 2025, item 514, as amended; hereinafter "Sanctions Act"); 2) meet the conditions for participation in the Proceedings specified by the Ordering Party. 4. The Contractor is obliged to deliver to the place indicated by the Ordering Party in the Order, located in one of the locations indicated in point 2.1.2 of the notice. with tender notice no. 680346-2026 published on 07 Oct 2026.
