In the description of the subject of the contract, constituting Appendix 6 to the ToR, the Contracting Authority has described the requirements for management systems relating to the production process of the offered equipment by reference to the standards indicated in item 9 of Table 1 of the description of the subject of the contract. Whenever these standards are indicated in the content of the ToR, including in the annexes to the ToR, such reference should be understood to be accompanied by the words "or equivalent." Thus, the Contracting Authority allows solutions equivalent to the standards indicated in item 9 of Table 1 of the description of the subject of the contract, in accordance with Art. 101, sections 4 and 5 of the Public Procurement Law. Equivalence should be understood as meaning that the offered equipment comes from production covered by an implemented and current management system that meets the requirements specified in item 9 of Table 1 of the description of the subject of the contract to an equivalent degree. The equivalent solutions used must correspond, in their type and scope, to the purposes of the standards referred to in item 9 of Table 1 of the description of the subject of the contract. 7. Due to the possibility of various equivalent proposals, the Contractor is required to verify and treat all solutions as interrelated. Demonstrating equivalence, i.e., equivalent fulfillment of the requirements specified by the Ordering Party in the description of the subject of the contract, rests with the Contractor. If the offered equipment comes from production covered by a management system compliant with an equivalent standard or another solution equivalent to the standards indicated in item 9 of Table 1 of the description of the subject of the contract, the Contractor is obligated to indicate this solution in item 5 of the offer form, constituting Appendix 1 to the Technical Specifications, provide information on the offered equivalent solution, a justification for its equivalence, and evidence confirming equivalence. The Ordering Party will not reject the Contractor's offer solely because the offered equipment does not come from production covered by management systems compliant with the standards indicated in item 9 of Table 1 of the description of the subject of the contract, provided that the Contractor proves in the offer, in particular using the evidence referred to in Articles 104-107 of the Public Procurement Law,that the proposed solutions meet the requirements specified by the Ordering Party in item 9 of Table 1 of the description of the subject of the contract to an equivalent extent (art. 101 sec. 5 of the Public Procurement Law). 8. After signing the contract, the Ordering Party intends to apply for a 0% VAT rate on the basis of art. 83 sec. 14 item 1 of the Act of 11 March 2004 on Goods and Services Tax (consolidated text: Journal of Laws of 2025, item 775, as amended). with tender notice no. 684811-2026 published on 07 Oct 2026.
