Subject of the order: 1) The subject of the order is the supply of a telekomando X-ray machine with equipment for the Diagnostic Imaging Department of the Zofia née Zamoyska Tarnowska Provincial Hospital in Tarnobrzeg. II. Description of the subject of the order: 1. CPV code according to the Common Procurement Vocabulary: 33100000 – 1 Medical devices 2. A detailed description of the subject of the order is included in Appendix No. 2 to the Technical Specifications – Assortment and Price Form. 3. The Contractor is obliged to complete all items in Appendix No. 2 to the Technical Specifications. 4. The subject of the order includes: 1) Purchase of medical equipment; 2) Delivery of the above-mentioned equipment; 3) Assembly/installation, commissioning, conducting tests and checks of the above-mentioned equipment; 4) Training of designated employees of the Ordering Party in the operation of the above-mentioned equipment1; 5) Warranty service of the above-mentioned equipment, on the terms specified in § 81; 6) Delivery of a warranty card for the above-mentioned equipment2; 7) Delivery of a technical passport for the above-mentioned equipment1; 8) Delivery of the equipments operating instructions in paper form in Polish, in electronic form in Polish, and technical (service) documentation. 5. Medical devices that are the subject of this contract must comply with the requirements of the current legal status, in particular those introduced by the Act of 7 April 2022 on medical devices (Journal of Laws of 2024, item 1620, as amended). 6. Equivalent solutions and criteria for assessing equivalence: 1) The Ordering Party will consider as equivalent to the specified solution a solution with the same purpose, technical, qualitative and functional features corresponding to the technical, qualitative and functional features indicated in the description of the subject of the order, or better, marked with a different trademark, patent or origin. 2) The equivalent solution must achieve the Contracting Authoritys intended goal through performance and functional parameters that impact operational effectiveness, which are the same as or better than the specified minimum requirements. 3) The use of solution, material, and device names in the description of the subject matter of the contract serves to establish a minimum standard of performance and to define the properties and technical requirements assumed in the technical documentation for the designed solutions. 4) The Contractor is obligated to demonstrate that the offered equivalent solutions will meet the assumed minimum requirements. 5) The absence of the term "minimum" indicates a minimum requirement, and the Contractor may offer a solution with better parameters. 6) In order to maintain the principles of technological neutrality and competitiveness, solutions equivalent to the specified ones are permitted. An equivalent solution is considered to be one that, in terms of technology, performance, and functionality, does not differ from, or is superior to, the technology, functionality, and performance specified in the specified solution. 7) Features of the solution that are unique to the specified solution, such as:Proprietary patents, proprietary technological solutions, proprietary protocols, etc., but only those that constitute the essence of the entire proposed technological solutions and are referenced in an equivalent solution. Therefore, the Contractor may propose solutions that implement the same functionalities specified by the Ordering Party in a manner other than the one specified. 8) Very similar (similar) utility value is understood as similar, with the allowance for minor differences that do not in any way affect the overall system, behavior, and implementation of similar functionalities under the given conditions for which these solutions are dedicated. The equivalent solution must include documentation confirming that it meets the Ordering Partys functional requirements, including the results of comparisons, tests, and capabilities offered by this solution in relation to the specified solution. 9) Other information in the Specification of Technical Specifications with tender notice no. 697238-2026 published on 09 Oct 2026.
