Delivery of additional Dynatrace or equivalent software subscriptions along with technical support and expert hours

The Central Information Technology Center in Poland from Europe region has released this tender for 1. The subject of the order is the delivery of additional Dynatrace subscriptions or an equivalent solution, together with technical support and expert hours. 2. The order is divided into a basic order and an option right: 2.1. Basic order: delivery of a Subscription covering the products specified in the Table presented in point 5.1. of Chapter II of the SWZ – OPZ or an equivalent solution, in accordance with the equivalence description specified in point 8 of the OPZ, together with the provision of Manufacturer Technical Support – in accordance with Chapter II of the SWZ – OPZ; 2.2. Order under the option: 2.2.1. Provision of Expert Support, up to 3,000 man-hours – on the terms described in detail in point 6 of Chapter II of the SWZ – OPZ. 2.2.2. Extension of currently used Subscriptions (568 Host Unit Offline, 25 million DEM Units Offline, 1 million DDU Units Offline) or providing equivalent licenses together with Manufacturer's Technical Support for a period of 12 months from 03/04/2027. 3. The subject of the order is described in detail in Chapter II of the Technical Specifications – Description of the subject of the order. 4. In accordance with Art. 139 of the Public Procurement Law, the Ordering Party provides for a reverse order of offer evaluation, i.e. it will first examine and evaluate the offers, and then select the Contractor whose offer was rated the highest in terms of the absence of grounds for exclusion and meeting the conditions for participation in the procedure. 5. The Ordering Party is the controller of personal data within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, hereinafter "GDPR". 6. The Contractor submits its offer via the eProcurement Platform of the Public Procurement Office - https://ezamowienia.gov.pl/pl/. 7. The Contracting Authority reserves that, in accordance with Art. 257 of the Public Procurement Act, it may cancel the contract award procedure if the public funds that the Contracting Authority intended to allocate to finance the contract are not awarded to it. 8. The offer must be submitted, under pain of nullity, in electronic form, in accordance with the requirements strictly specified in the ToR. 9. The Contracting Authority will not award the contract if the circumstances referred to in Art. 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning organisational measures in connection with Russia's actions destabilising the situation in Ukraine (OJ EU No. L 229/1 of 31.7.2014) occur and will exclude the Contractor if at least one of the exclusion grounds specified in Art. 7 sec. 1 of the Act of 13 April 2022 on special solutions for counteracting support for aggression against Ukraine and serving to protect national security (i.e. Journal of Laws of 2025, item 514) – in order to confirm the absence of grounds for exclusion, a declaration constituting Annex No. 7 to the Offer Form should be submitted together with the offer. with tender notice no. 674651-2026 published on 06 Oct 2026.
