The Contractor is obligated to perform the contract under the terms and conditions described in the draft provisions of the contract, which constitute Appendix No. 5 to the ToR. 6. The Contractor is obligated to clearly identify the products offered, characterizing them by providing the required information enabling identification of the offered subject of the contract in the item-price form, which constitutes Appendix 4 to the Technical Specifications. The form constitutes the content of the offer and does not require supplementation. The Ordering Party also requires the submission of the relevant evidence together with the offer (technical documentation for each element of the offered subject of the order specified in Appendix No. 3, i.e. for the server, desktop computer set (central processing unit, monitor, keyboard, mouse) confirming that the offered supplies meet the requirements specified by the Ordering Party in the order documents. Detailed information is provided in Chapter XVII of the Technical Specifications. 7. In accordance with the possibilities provided by the Act of 11 March 2004 on the tax on goods and services (art. 83 sec. 1 item 26 letter a of this Act - i.e. Journal of Laws of 2026 item 1263), the Ordering Party will take steps to apply the "zero" VAT rate to servers and desktop computer sets, which are included in Appendix No. 8 to this Act. If the Ministry of Science and Higher Education does not send the appropriate certificate within the invoice issuing deadline, the Contractor will issue an invoice with VAT, and after receiving the above-mentioned certificate, it will issue an invoice correcting VAT. 8. The subject of the order must be brand new, without previous use, technically efficient, free from legal and physical defects, compliant with the recommendations, standards and applicable technical and operational requirements in force in the territory of the Republic of Poland. 9. Nomenclature (code) according to CPV - 48822000-6 Computer servers, 48820000-2 Servers, 30213000-5 Personal computers, 30213300-8 Desktop computer, 30231300-0 Display monitors, 30237200-1 Computer accessories. 10. Guarantee and warranty: The Ordering Party requires,The Contractor must provide a guarantee and warranty for the offered subject of the contract for at least 24 months, counted from the date of signing the handover protocol without any reservations. 11. The Ordering Party requires that the entire order be completed within 14 calendar days of the date of conclusion of the contract. The Ordering Party hereby informs that, due to the terms of funding, the final, strict deadline for the completion of both parts of the contract, financed by the Ministry of Science and Higher Education, is set at December 15, 2026. This is the maximum deadline for the completion of the subject of the contract, counted from the date of conclusion of the contract to the date of signing the handover protocol without any reservations. Note: The final deadline for the completion of the entire contract and payment of the invoice is set at December 31, 2026. After this date, the Ordering Party will not have the funds to complete the subject of the contract and will withdraw from the contract without setting an additional deadline, and the Contractor will not make any claims against the Ordering Party in this regard. The Contracting Authority requires that the offered service, including all ICT products, ICT services and ICT processes used to perform the contract, whether as main elements, components, elements of the service provision environment or accompanying solutions, does not include: 1) ICT products, ICT services or ICT processes indicated in the recommendation referred to in art. 33 sec. 4 of the Act of 5 July 2018 on the national cybersecurity system, stating their negative impact on the fundamental security interest of the state; 2) an ICT product the type of which was specified in the decision on recognizing the supplier as a high-risk supplier, referred to in art. 67b sec. 15 of the Act of 5 July 2018 on the national cybersecurity system, or ICT services or ICT processes specified in that decision. Failure to meet the above requirement will result in rejection of the offer on the basis of art. 226 sec. 1 item 17 or item 19 of the Public Procurement Act, respectively.including all ICT products, ICT services and ICT processes used to perform the contract, both as main elements and components, elements of the service provision environment or accompanying solutions, did not include: 1) ICT products, ICT services or ICT processes indicated in the recommendation referred to in art. 33 sec. 4 of the Act of 5 July 2018 on the national cybersecurity system, stating their negative impact on the fundamental interest of state security; 2) an ICT product the type of which was specified in the decision on recognizing the supplier as a high-risk supplier, referred to in art. 67b sec. 15 of the Act of 5 July 2018 on the national cybersecurity system, or ICT services or ICT processes specified in that decision.
