The Ordering Party allows for the performance of part of the order to be entrusted to a subcontractor. 7. The Ordering Party requests the Contractor to indicate in its offer the parts of the contract the performance of which it will entrust to subcontractors, and to provide the names of any subcontractors, if they are already known. 8. In accordance with art. 13 paragraphs 1 and 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (i.e. OJ L 119, 4.05.2016, p. 1), hereinafter referred to as "GDPR", the Ordering Party informs that: 1) the controller of your personal data is the Commander of the Warsaw Police; 2) supervision over the proper processing of personal data is exercised by the personal data protection inspector: address: ul. Nowolipie 2, 00-150 Warsaw; e-mail address: iod@ksp.policja.gov.pl 9. The type and scope of changes to the contract are included in Chapter XIX of the Technical Specifications. 10. The Ordering Party allows for the submission of partial offers divided into two tasks: Task No. 1 – Unmarked motorcycle helmet; Task No. 2 – Marked motorcycle helmet with a communication system. 11. The award of the contract in question may be applied for by Contractors who are not subject to exclusion under art. 108 sec. 1 and sec. 2 of the Act and art. 109 sec. 1 points 1, 4, 7, 8 and 10 of the Act and art. 7 sec. 1 of the Act of 13 April 2022 on specific solutions for counteracting support for aggression against Ukraine and serving to protect national security (Journal of Laws of 2025, item 514) and art. 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilizing the situation in Ukraine (OJ EU No L 229, 31.7.2014, p. 1), as amended, hereinafter referred to as: Regulation 833/2014, in the version set out in Council Regulation (EU) 2022/576 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilizing the situation in Ukraine (OJ EU No L111, 8.4.2022, p. 1) and as amended by Council Regulation (EU) 2025/2033 of 23 October 2025 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilizing the situation in Ukraine the situation in Ukraine. PROCUREMENT PROCEDURE: 12. In this procedure, the Ordering Party does not purchase any products. The purpose of this procedure is for the Ordering Party to conclude framework agreements with a maximum of 3 (three) Contractors, whose offer prices, calculated in accordance with the provisions of Chapter XIII, section 2 of the ToR, will not exceed the amount that the Ordering Party can allocate to finance the framework agreement and will be ranked 1 to 3 in the offer evaluation criteria, unless fewer Contractors submit offers that are not subject to rejection. 13. The Ordering Party will commence the contract award procedure in accordance with the provisions of §3, Chapter XIX of the ToR. 14. The Ordering Party does not require the Contractor to demonstrate compliance with the conditions for participation in the procedure specified in Article 112, section 2 of the Act. with tender notice no. 660588-2026 published on 25 Sep 2026.
