The parties, in accordance with Article 455, paragraph 1, point 1 of the Public Procurement Act, stipulate that a change to the contract may occur under the following principles and conditions: 1) If there is a change in the VAT rate and/or excise tax rate, the contracting party shall apply the VAT rate in effect at the time of invoice issuance, and the change in the gross price from this cause is accepted by the parties without the need to submit additional declarations; 2) In case of a change in the product name or catalog number – with the product and producer unchanged (the change may only concern the name assigned by the producer); 3) In case of a change in the packaging method – the quantity shall be recalculated to the appropriate number of packages or units per package, and the unit price shall be proportionally recalculated for the new packaging size; 4) In case of a medical incident – the possibility of introducing an equivalent product with no lower quality and functional parameters and not a higher price than the product affected by the incident; 5) If there are no products on the market for reasons independent of the Supplier (e.g., cessation of production, withdrawal from circulation, or lack of supply on the market) – the possibility of substituting with an equivalent product at a price not higher than the price of the withdrawn or missing product, or termination of the contract without applying the penalty referred to in paragraph 3; 6) The parties may extend this contract for up to four months in the following cases: a) the quantity of the goods covered by the contract is not exhausted within the term of its validity – to the extent of the quantity of the goods covered by the contract; b) an increase in the value of the contract in accordance with Article 455, paragraph 2 of the Public Procurement Act; 7) In case of a change in the minimum wage for work or the minimum hourly rate, established based on the Act on Minimum Wages and/or changes in the social insurance or health insurance rules, or the rate of social or health insurance contributions, or changes in the rules and amounts of contributions to employee pension funds (as specified in the relevant provisions) – the contract change may occur no earlier than 12 months after the date of contract signing, and either party may request negotiations with the other party regarding the appropriate adjustment of the wage – subject to the condition that the changes mentioned above affect the costs incurred by the Supplier in fulfilling the contract terms. with tender notice no. 685073-2026 published on 07 Oct 2026.
