The quantitative scope of the subject of the order is an estimate determined by the Ordering Party with due diligence. Despite exercising due diligence, the Ordering Party, due to the nature of its business, does not guarantee full execution of the order. 4. In order to confirm that the offered service complies with the Ordering Partys requirements, the relevant evidence must be submitted with the offer. 5. The Ordering Party does not allow the submission of variant offers. 6. The Ordering Party allows the possibility of offering more than one product (products from different manufacturers) within a single item of the offer form. If the contractor offers more than one product (from different manufacturers) in a given item of the bid form, the following is required: a) for each offered product to meet the requirements specified in the Technical Specifications (SWZ), b) to submit the required evidence for all offered products. A bid that offers products from different manufacturers within a single item of the bid form is deemed compliant with the SWZ requirements, provided that all offered products within a given item of the bid form meet the requirements. If even one of the offered products fails to meet the requirements, the bid is subject to rejection pursuant to Article 226, Section 1, Item 5 of the Public Procurement Law. The Ordering Party reserves the right to change the quantity of goods ordered within individual product lines and to place orders according to actual needs. The Ordering Party declares that the minimum guaranteed level of contract performance is 50% of the value of the awarded order. The Contractor is not entitled to claims for a greater scope of contract performance. 7. The procedure for the award of a utilities contract is conducted as an open tender based on the provisions of the Act of 11 September 2019 (Journal of Laws, item 2019, as amended), hereinafter referred to as the Public Procurement Act. 8. The procedure is conducted in Polish. 9. The information obligation arising from Articles 13 and 14 of the Regulation of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU L. 2016.119.1 of 4 May 2016) (hereinafter referred to as "GDPR") is fulfilled on the PGG SA website in the GDPR tab, in the "Contractors/Contractors Employees" annex. In the case of processing personal data for purposes related to the public procurement procedure,The Ordering Party has fulfilled the information obligation in the Buyer Profile on the Polska Grupa Górnicza website in the "PZP Information Obligation" tab. 10. Additionally, the Ordering Party informs that a) the exercise by the data subject of the right to rectification or supplementation referred to in Article 16 of the GDPR may not result in a change in the outcome of the procurement procedure or an amendment to the provisions of the public procurement contract to an extent inconsistent with the Act. b) in the procurement procedure, submitting a request to restrict processing referred to in Article 18 paragraph 1 of the GDPR does not limit the processing of personal data until the completion of that procedure. 11. The Ordering Party allows the submission of partial offers for individual lots of the order (tasks) specified in Appendix No. 2 to the ToR. The submitted offer should cover the entire material and quantitative scope of the order. The number of lots (tasks) is: 7.
