DELIVERY OF VARIOUS MEDICINAL PRODUCTS, INCLUDING MEDICINAL PRODUCTS FROM DRUG PROGRAMS AND MEDICAL DEVICES

The COPERNICUS MEDICAL ENTITY LIMITED LIABILITY COMPANY in Poland from Europe region has released this tender for The subject of the order is the supply of various medicinal products, including medicinal products from drug programmes and medical devices (CPV: 33.69.00.00-3, 33.65.21.00-6, 33140000-3 medical materials) for the needs of Copernicus Podmiot Leczniczy Sp. z o.o. in Gdańsk, a detailed description, assortment and estimated quantities of which are included in the Assortment and Pricing Form - Appendix No. 1 to the SWZ (parts no. 1-42). The offered subject of the order must be approved for trading and use in accordance with applicable law. The subject of the order must comply with the Act of 7 April 2022 on Medical Devices (Journal of Laws of 2022, item 974, as amended) and/or the Pharmaceutical Law Act of 6 September 2001 (Journal of Laws of 2022, item 2301, as amended) – if applicable. In the case of assortments identified by trade names, the Ordering Party allows offers for assortments that are equivalent in all respects, i.e., composition, weight, range, spectrum and duration of operation, form, function, etc., provided that they guarantee the performance of the subject of the contract in accordance with the assumptions specified in this ToR. In the case of equivalent assortments, the Contractor is obligated to provide their trade name, catalog number, and manufacturers name. Demonstrating the equivalence of the offered solution or equivalent solutions rests with the Contractor. In all provisions of the ToR and its annexes in which the Ordering Party refers to standards, approvals, technical specifications, or reference systems, or in which trademarks, parameters, or sources of origin (names of manufacturers or devices) are indicated, the Ordering Party allows equivalent solutions in accordance with Article 99, Section 5, and Article 101, Section 4 of the Public Procurement Law. The Ordering Party does not reserve the right to apply for the contract only to Contractors referred to in Article 94 of the Public Procurement Law. The Ordering Party does not impose the requirements referred to in Article 96 of the Public Procurement Law. The method of execution of the subject of the order is specified in the draft agreement contained in Appendix No. 5 to the ToR. The Ordering Party does not anticipate that the Contractor will conduct an on-site inspection or verify the documents necessary to execute the order available on-site at the Ordering Partys premises in order to submit a bid. To confirm that the offered supplies meet the requirements specified by the Ordering Party, the Ordering Party requires the following evidence to be submitted with the bid: for lot No. 17 – 3 samples of the offered assortment. The Ordering Party waives the requirement to use electronic means of communication with regard to the requirement to submit samples. The submitted samples must be consistent with the description contained in Appendix No. 1 – Assortment and Pricing Form. Samples will be submitted in accordance with the provisions of § XII of the ToR. If equivalent solutions are offered – other than those specified in the ToR – the bid must be accompanied by documents confirming that the equivalent solutions used meet the Ordering Partys requirements (e.g., descriptions, catalog cards, technical data sheets).Jeżeli Wykonawca nie złoży przedmiotowych środków dowodowych wskazanych powyżej, lub złożone przedmiotowe środki dowodowe będą niekompletne, Zamawiający wezwie do ich złożenia lub uzupełnienia w wyznaczonym terminie. Zamawiający informuje, że dokona badania i oceny ofert, a następnie dokona kwalifikacji podmiotowej Wykonawcy, którego oferta została najwyżej oceniona, w zakresie braku podstaw wykluczenia oraz spełniania warunków udziału w postępowaniu. W związku z tym Wykonawcy nie składają wraz z ofertą oświadczenia JEDZ, o którym mowa w art. 125 ust. 1 ustawy Pzp. Zamawiający, przed wyborem najkorzystniejszej oferty, wezwie Wykonawcę, którego oferta została najwyżej oceniona, do złożenia w wyznaczonym, nie krótszym niż 10 dni terminie, aktualnych na dzień złożenia następujących podmiotowych środków dowodowych określonych w § X SWZ. The Ordering Party hereby informs that it will examine and evaluate the offers, and then subjectively qualify the Contractor whose offer was rated highest, in terms of the absence of grounds for exclusion and compliance with the conditions for participation in the procedure. Therefore, Contractors do not submit the ESPD declaration referred to in Art. 125 sec. 1 of the Public Procurement Law with their offer. Before selecting the most advantageous offer, the Ordering Party will request the Contractor whose offer was rated highest to submit, within a specified deadline of no less than 10 days, the following subjective evidence specified in § X of the Technical Specifications, current as of the date of submission.
