Design documentation describing the proposed materials and equipment should be prepared in accordance with Article 99 of the Public Procurement Law. The subject of the contract may not be described in a manner that could hinder fair competition, in particular by specifying trademarks, patents, or the origin, source, or specific process that characterizes products or services provided by a specific contractor, if this could lead to favoring or eliminating certain contractors or products. Pursuant to Article 101 paragraph 4 of the Act, where the subject of the contract is described using standards, technical assessments,technical specifications and technical reference systems, the Ordering Party accepts solutions equivalent to those described. Furthermore, it should be assumed that all such references are accompanied by the words "or equivalent." Indicating the equivalence of the offered solution in accordance with Art. 101, section 5 of the Act and under the principles set out therein rests with the Contractor. 8. In the case of a description using standards, equivalent solutions are considered to be those that ensure compliance with the minimum requirements specified in the standard at a level no worse than that described in the relevant standards. In the case of standards referenced in the Specifications of Conformity (unless specified in detail), current standards are understood. In other cases (description of the subject of the contract using technical assessments, technical specifications and technical reference systems), equivalent is considered to be a product, material or system with technical, functional and quality parameters no worse than those specified in the description of the subject of the contract.
