A detailed description of the subject of the Order can be found in the Technical Specifications (Part IV of the Technical Specifications). If the developed design documentation indicates trademarks, patents, or the origin, source, or specific process that characterizes the product or services delivered by a specific contractor, the Designer is obligated to allow equivalent solutions. If the design documentation refers to standards, European Technical Assessments, approvals, technical specifications, and technical reference systems, the Designer allows solutions equivalent to those described. 3. The subject of the order has not been divided into lots. The Ordering Party does not allow partial offers. 4. The Ordering Party intends to award contracts referred to in Art. 214, Section 1, Item 7 of the Public Procurement Law up to a net value of PLN 591,250.00. A similar contract includes: 1) Design work on the road section covered by the basic contract and on sections and areas adjacent to the road covered by the basic contract in all sectors: roads, bridges, sanitary, energy, telecommunications. 2) Geological surveys on the road section covered by the basic contract and on sections and areas adjacent to the road covered by the basic contract. 5. During the performance of the contract, the Contractor is obligated to maintain a current third party liability insurance (OC) policy throughout the entire contract period, at least in the scope equivalent to the scope of the service entrusted to be performed and for a guarantee sum of no less than PLN 1,100,000.00. The Ordering Party allows for a situation in which the Contractor will systematically submit, during the contract term, policies confirming the possession of third party liability insurance meeting the above-mentioned parameters, instead of a single policy for the entire contract term. The Contractor is obligated to submit the third party liability insurance policy no later than 7 days from the date of conclusion of the contract. If the Contractor fails to submit the third party liability insurance policy within 3 months of signing the contract, the Ordering Party will be entitled to withdraw from the contract for reasons attributable to the Contractor. 6. Contract completion date: 24 months from the date of signing the contract. 7. The Contractor,whose offer was selected as the most advantageous will provide a performance security of 5% of the total price specified in the offer. Requirements regarding the performance security are described in Chapter XX, Part I of the ToR. 8. The Ordering Party intends to apply the so-called reverse procedure referred to in Article 139, Section 1 of the Public Procurement Law, i.e. the Ordering Party will first examine and evaluate the offers, and then subjectively qualify the Contractor whose offer was rated the highest, in terms of the absence of grounds for exclusion and meeting the conditions for participation in the procedure. 9. Pursuant to Article 257 of the Public Procurement Law, the Ordering Party envisages the possibility of invalidating the procedure in question if the public funds that the Ordering Party intended to allocate to finance all or part of the contract have not been awarded to it. with tender notice no. 682852-2026 published on 07 Oct 2026.
