In order to demonstrate that the Contractor meets the conditions referred to in art. 57 of the Public Procurement Act, the Contractor shall submit: a) a declaration on meeting the conditions for participation in the procedure – signed by the person(s) authorized to represent the Contractor. The Contractor shall submit the relevant declaration in the form of a single document constituting Appendix No. 4 to the Specification (JEDZ form); 2. In order to confirm the lack of grounds for exclusion from the Procedure in the circumstances referred to in art. 108 of the Public Procurement Act and art. 109 sec. 1 item 1 and item 4 of the Public Procurement Act and art. 7 sec. 1 of the Act of 13 April 2022 on specific arrangements to counteract support for aggression against Ukraine and to protect national security (i.e. Journal of Laws of 2025, item 514) and Art. 5k paragraph 1 of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilizing the situation in Ukraine (OJ EU L 229, 31.07.2014, p. 1, as amended), the Contractor submits: a) a declaration on the lack of grounds for exclusion from the procedure – completed and signed by the person(s) authorized to represent the Contractor. The Contractor shall submit the relevant declaration in the form of a single document constituting Appendix No. 4 to the Specification (JEDZ form), b) a declaration that the Contractor is not subject to exclusion from the procedure under Art. 7 section 1 of the Act of 13 April 2022 on specific solutions to counteract support for aggression against Ukraine and to protect national security (i.e. Journal of Laws of 2025, item 514) and is not subject to a prohibition on the award or further performance of any public contracts under Article 5k section 1 of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilizing the situation in Ukraine (OJ EU L 229, 31.07.2014, p. 1, as amended) – completed and signed, as appropriate, by the person(s) authorized to represent the Contractor - Appendix No. 2 to the Specification. 3.The Proceedings may be participated in by Contractors who are not subject to exclusion from the proceedings under Article 108 of the Public Procurement Act and Article 109 paragraph 1 item 1 and item 4 of the Public Procurement Act, and are not subject to exclusion from the proceedings under Article 7 paragraph 1 of the Act of 13 April 2022 on specific solutions to counteract support for aggression against Ukraine and to protect national security (i.e. Journal of Laws of 2025 item 514), and are not subject to a prohibition on the award or further performance of any public contracts under Article 5k paragraph 1 of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia’s actions destabilizing the situation in Ukraine (OJ EU L 229, 31.07.2014, p. 1, as amended).
