The subject of the order must be brand new and unused, and must be free from physical and legal defects. 7. The Contractor is obliged to: 1) Deliver the goods to the location (including specific rooms) indicated by the Contracting Authority. 2) Cover the delivered goods with a warranty. 8. The Contracting Authority guarantees the placement of orders for the delivery of the subject of the order at a level of no less than 50% of the gross contract value. Performance of the contract beyond this level will depend on the actual needs of the Contracting Authority (recipients resulting from personnel changes) and the financial resources allocated for this purpose. 9. The Contractor shall not be entitled to any claims for compensation arising from the Contracting Authority’s failure to place or execute orders exceeding 50% of the maximum gross contract value. 10. The goods must comply with Polish standards transposing European standards, or with standards of other European Economic Area member states transposing such standards, or with parameters relating to such standards.
