Tender Summary
The Muzeum Historyczne Miasta Krakowa in Poland from Europe region has released this tender for The contracting authority does not allow partial bids. The subject of the contract includes the production, delivery, and installation of permanent exhibition design elements, which constitute an integral part of a single museum exhibition, implemented based on a unified scenographic, architectural, and substantive concept. The individual exhibition elements are closely interconnected functionally, technically, and aesthetically, and their proper execution requires full compatibility of material, structural, multimedia, and finishing solutions. Dividing the contract into parts would increase the risk of discrepancies in the quality of workmanship, technologies used, colors, finishing methods, and integration of individual exhibition elements, which could negatively impact the narrative and aesthetic coherence of the exhibition. The lack of division of the contract is also justified by the need to ensure timely completion of the project. If the contract is executed by multiple contractors, the risk of delays resulting from the need to coordinate schedules, transfer work sites, and resolve liability for any discrepancies or conflicts between individual exhibition elements would increase. Furthermore, the execution of the contract by a single contractor will allow for effective enforcement of warranty and guarantee liability for the entire completed arrangement, which is particularly important in the case of a museum facility, where all exhibition elements function as a single, integrated system. The Ordering Party also assesses that the lack of division of the contract into lots does not unjustifiably restrict competition. There are specialized entities on the market experienced in the comprehensive implementation of museum exhibitions and permanent displays, including the production, delivery, and installation of arrangement elements. Requirements for contractors will be defined in a manner proportional to the subject of the contract and enabling fair competition. Therefore, the Ordering Party recognizes that awarding the contract in a single procedure, without division into lots, is the most rational solution from an organizational, technical, economic, and qualitative perspective and will ensure the achievement of the intended exhibition effect. CD documents submitted upon request: 2) Contractors Declaration (this also applies to third parties) within the scope resulting from Article 108, paragraph 1 point 5 of the Public Procurement Law, on not belonging to the same capital group within the meaning of the Act of 16 February 2007 on Competition and Consumer Protection with another Contractor who submitted a separate offer, partial offer or a declaration of belonging to the same capital group together with documents or information confirming the preparation of offers or partial offers independently of another contractor belonging to the same capital group – in accordance with the content of Annex No. 5 to the Technical Specifications,3) Information from the National Criminal Register within the scope of Art. 108 sec. 1 items 1 and 2 of the Act and Art. 108 sec. 1 item 4 of the Act, concerning a ruling prohibiting application for public contracts as a penal measure, prepared no earlier than 6 months before its submission. If the Contractor has its registered office or place of residence, or the person to whom the information or document relates has its place of residence, outside the Republic of Poland, instead of the information from the National Criminal Register referred to above, it shall submit information from the appropriate register, such as a court register, or, in the absence of such a register, another equivalent document issued by a competent judicial or administrative authority in the country in which the contractor has its registered office or place of residence, within the scope of Art. 108 sec. 1 items 1 and 2 of the Act and Art. 108 sec. 1 item 4 of the Public Procurement Act.
