The subject of the order is the delivery and installation of complete photovoltaic micro-installations for 8 public utility facilities, the installation of energy storage units for 9 buildings, the modernization of the existing fire protection switch installation and the execution of the necessary accompanying general construction works, as well as an energy production monitoring system. 2. The scope of the order and its description can be found in the Specification of Technical Specifications (SWZ) and in the annexes thereto, i.e.: a detailed description of the subject of the order (SWZ) and the draft contract provisions. 3. Pursuant to art. 95 sec. 1 of the Public Procurement Law, the Ordering Party hereby informs that it places requirements regarding employment by the Contractor or Subcontractor on the basis of an employment relationship of persons performing activities within the scope of the order, consisting in performing work in the manner specified in art. 22 § 1 of the Act of 26 June 1974 - Labor Code (consolidated text: Journal of Laws of 2020, item 1320, as amended). Details regarding the above-mentioned requirement, the method of employment verification, and the Ordering Partys control rights are contained in the draft contract provisions, which constitute an annex to the ToR. 4. The order is covered by financial support: The project is co-financed by the European Union under the European Funds for Silesia 2021-2027 (Just Transition Fund) for Priority: FESL.10.00 - European Funds for Transition for Measure: FESL.10.06 - Development of distributed energy based on renewable energy sources. 5. The Ordering Party does not allow the submission of variant offers. 6. The Ordering Party does not allow the submission of partial offers under this order. Despite the dispersion of the facilities, the order constitutes a functional and technically interconnected whole. The scope of work includes the construction of photovoltaic installations according to uniform technical requirements, including the delivery of equipment and materials, assembly of photovoltaic structures and modules, electrical installations, connection to existing infrastructure, system configuration, and the completion of necessary measurements and as-built documentation. The lack of division of the contract into lots is also justified by the need to ensure a uniform standard of execution for all installations, compatibility of the devices used, and clear assignment of responsibility for the proper operation of the entire contract scope to a single contractor. Splitting the contract among several contractors could lead to difficulties in coordinating the work, determining liability for any irregularities, and in terms of warranty and service. Individual locations are not functionally separate contract items, but rather elements of a single investment project, implemented according to common assumptions and requirements. Furthermore, conducting a single procedure allows for efficient coordination of implementation.Reducing costs and ensuring uniform warranty and service conditions for all completed installations. Therefore, it is considered that the lack of division of the contract into lots is justified by technical, organizational, and economic reasons, and the implementation of the entire scope of the contract in a single procedure will allow for maintaining the technical and organizational coherence of the project and the Contractors implementation of integrated monitoring of all installations covered by this contract. Furthermore, in the Ordering Partys opinion, the lack of division of the contract into lots does not limit the quantitative or qualitative participation of Small and Medium-sized Enterprises. The decision on dividing the contract into lots is at the Ordering Partys discretion, in accordance with the Public Procurement Law and the provisions contained therein establishing the obligation for contracting authorities to divide the contract into lots. However, Art. 91 sec. 1 of the Public Procurement Law should be interpreted in conjunction with Art. 91 sec. 2 of the Public Procurement Law to examine whether the reasons for not dividing the contract into lots violate the procedural principles expressed in Art. 16 item 1 of the Public Procurement Law. The lack of division of the contract into lots does not in any way limit the principle of fair competition. The provision of Art. Article 91, section 1 of the Public Procurement Law indicates that the Contracting Authority may award a contract in parts – therefore, it does not constitute a source of obligation for the Contracting Authority, and it cannot be used as a basis for raising objections against the Contracting Authority for failing to do so. However, Article 91, section 2 of the Public Procurement Law creates an obligation to include a justification in the procurement documents in the event of failure to divide the contract. This is an information obligation, the implementation of which can be verified. Therefore, the content of the justification provided by the Contracting Authority is important. The fact that the Contracting Authority may award a contract in parts does not constitute a source of obligation for the Contracting Authority, and cannot be used as a basis for raising objections against the Contracting Authority for failing to do so.
