The estimated quantity of oil that the Ordering Party plans to order under the concluded agreement is 535.00 m3 (scope of the "basic order"). The quantity and delivery dates are indicative, and the actual quantity of heating oil ordered is limited by the gross amount (the amount the Ordering Party intends to allocate to finance the order) and will result from the Ordering Partys current needs and its storage capacity for the subject of the order. 6. In accordance with Art. 441 of the Public Procurement Law, the Ordering Party allows for the exercise of an option right in this procedure up to 150% of the value of the basic order (i.e. the amount the Ordering Party intends to allocate to finance the basic order). 7. If, during the execution of the order, it turns out that the Ordering Party has the financial resources and the need to order a larger quantity of heating oil than anticipated in the unconditional scope of the order, the Ordering Party reserves the right to exercise the option right and order additional oil, under the concluded agreement. 8. In the event of an order for an additional quantity of the subject of the contract, settlement will be based on the offer of the selected Contractor and the concluded contract, calculated in the same manner as in the basic order. 9. The option right may only be exercised if the basic order is completed in 100%, i.e. the amount allocated for the implementation of the basic order is used. 10. The Ordering Party reserves the right that the part of the order designated as the option right is an entitlement, not an obligation, of the Ordering Party. The exercise of the option in whole or in part may, but does not have to, take place depending on the Ordering Partys needs and as a result of its instructions in this respect. Failure to complete the order in this respect may not give rise to any claims by the Contractor against the Ordering Party. 11. The Contractor agrees to subject its employees, collaborators, and means of transport to the rigors of safety procedures in force in Military Unit 1158 during the execution of the order in accordance with the requirements of the Act of 22 August 1997 on the Protection of Persons and Property (consolidated text: Journal of Laws of 2025, item532) within the scope of the "Internal Duty Services" and procedures related to the Act of 5 August 2010 on the Protection of Classified Information (consolidated text: Journal of Laws of 2025, item 1209). If the Contractor (subcontractor) plans to send foreigners to perform the order on the premises of Military Unit 1158, it should provide the Ordering Party (security commander) with a list of foreigners in order to obtain the necessary opinion regarding the entry of foreigners to the premises of the military institution from the appropriate local Branch of the Military Counterintelligence Service. The condition for obtaining permission for foreigners employed by the Contractor (subcontractor) to enter the premises of Military Unit 1158 is to obtain a positive opinion from the Military Counterintelligence Service regarding the entry of foreigners to the premises of the military institution and the consent of the Commander of Military Unit 1158. *waiting time up to 12 days. The Contractor employing foreigners declares that it will comply with applicable legal provisions in this respect, in particular: - the Act of December 12, 2013 on Foreigners (Journal of Laws of 2025, item 1079, as amended); - the Act of April 20, 2004 on employment promotion and labor market institutions (Journal of Laws of 2020, item 1409, as amended); - the Act of December 16, 2010 amending the Act on employment promotion and labor market institutions and certain other acts (Journal of Laws No. 257, item 1725, as amended); - the Act of July 14, 2006 on the entry into, stay in and departure from the territory of the Republic of Poland of citizens of European Union Member States and their family members (i.e. Journal of Laws of 2026, item 1065). 12.
