The Ordering Party will exclude from the proceedings a Contractor with respect to whom: at least one of the following applies: art. 7 sec. 1 of the Act of 13 April 2022 on specific solutions in the scope of counteracting support for aggression against Ukraine and serving to protect national security (Journal of Laws of 2025, item 514, as amended) at least one of the premises applies: art. 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia’s actions destabilizing the situation in Ukraine (OJ EU No. L 229, 31.7.2014, p. 1), in the wording given by Council Regulation (EU) 2022/576 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia’s actions destabilizing the situation in Ukraine (OJ EU No. L 111, 8.4.2022, p. 1) as amended. The Ordering Party, based on Art. 106 and Art. 107 of the Public Procurement Law, requests that the following evidence be submitted with the offer: 1) Technical specifications completed by the Contractor regarding the offered services, e-platform and equipment (according to the template constituting Appendix No. 1b to the Technical Specifications). The evidence in question serves to confirm that the offered services and supplies covered by this contract meet the requirements specified by the Contracting Authority. If the Contractor fails to submit the evidence in question, or the evidence submitted is incomplete, the Contracting Authority will request the Contractor to submit or supplement it within a specified timeframe. The Contracting Authority may request clarification from the Contractor regarding the content of the submitted evidence in question. The Contracting Authority hereby informs that for the subject matter of this contract, no capability levels have been determined in the manner provided for in Art. 112 sec. 3 of the Public Procurement Law, i.e. in the regulations issued on the basis of Art. 5 sec. 4 or sec. 5 of the Act of 5 August 2025 on the Certification of Public Procurement Contractors (Journal of Laws, item 1235 and of 2026, item 421). For this reason, the Contracting Authority, pursuant to Art. 112 sec. 1 and 2 of the Public Procurement Law, independently determines the conditions for participation in terms of technical or professional capability. A contractor who intends to use the certificate referred to in Article 24 of the Act of 5 August 2025.on the certification of public procurement contractors, the Contractor should select "YES" in Part II, Section A of the ESPD, in the field concerning entry in the official list of approved Contractors or possession of an equivalent certificate, and complete the next item of the ESPD in a manner enabling identification of the certificate. The Ordering Party recommends providing information on at least: the certifying entity; the validity period of the certificate; and the scope of certification that the Contractor intends to use in this public procurement procedure. The lack of information about the certificate in the ESPD does not deprive the Contractor of the possibility of submitting a certificate at the Ordering Party's request. Selecting information about having a certificate does not exempt the Contractor from the obligation to complete the ESPD to the extent indicated in the Specification of Certifications. Other information concerning certification: The Ordering Party indicates that: Pursuant to Art. 124 sec. 2 of the Public Procurement Law, the Contractor may, instead of the appropriate means of evidence required by the Ordering Party in the Specification of Certifications, submit a certificate confirming the granting of certification of public procurement contractors, referred to in Art. 24 of the Act of 5 August 2025 on the Certification of Public Procurement Contractors. The use of a certificate is the Contractor's right. The Ordering Party does not require a certificate as a condition for participation in the procedure; A certificate replaces subjective evidence only to the extent that its content confirms: a) the absence of specific grounds for exclusion from the procedure, or b) compliance with a specific condition for participation in the procedure; The Contractor submitting the certificate shall indicate which subjective evidence listed in the Specification of Essential Terms of the Contract (SWZ) is replaced by the certificate and to what extent the certificate confirms the absence of grounds for exclusion or compliance with the conditions for participation in the procedure; To the extent not covered by the certificate, the Contractor shall submit the subjective evidence required in the SWZ, i.e.: If the certificate does not cover all the grounds for exclusion indicated by the Ordering Party, the Contractor shall submit documents or declarations concerning the grounds not covered by the certificate; If the certificate does not cover all the conditions for participation in the procedure, the Contractor shall submit documents or declarations concerning the condition not covered by the certificate; If the certificate covers only part of the required condition for participation in the procedure, the Contractor is obliged to prove the remaining scope of the condition using the subjective evidence indicated in the SWZ; The Ordering Party will verify in particular: Validity of the certification; Certification status, including information on its suspension or expiry; Identity of the entity covered by the certification; Grounds for exclusion and conditions of participation covered by the certification; If the certification is suspended during the proceedings, the Ordering Party will request the Contractor to submit, within a period of not less than 5 days from the date of the request, subjective evidence in the scope,in which the certificate was to confirm the absence of grounds for exclusion or compliance with the participation conditions.
