technical specifications and technical reference systems the Ordering Party allows solutions equivalent to those described Furthermore it should be assumed that all such references are accompanied by the words or equivalent Indication of the equivalence of the offered solution in accordance with art 101 sec 5 of the Act and the principles specified therein rest with the Contractor In such a case the Contractor is obliged to prove by attaching to the offer the relevant evidence referred to in Art 104-107 of the Public Procurement Law that the proposed solutions meet the requirements specified in the description of the subject of the contract to an equivalent degree 5 If trademarks are used in the design documentation or technical specifications for the execution and acceptance of works this means that they are provided for example purposes and define only the minimum expected quality parameters and the required standard The Contractor may use equivalent materials or equipment but with similar or better technical and quality parameters the use of which will in no way negatively impact the proper functioning of the solutions adopted in the design documentation A Contractor who uses equivalent equipment or materials will be obliged to demonstrate during the execution of the contract that the materials and equipment they use meet the requirements specified by the Ordering Party 6 The use of a label in the design documentation means that the Ordering Party accepts all labels confirming that the given construction works supplies or services meet the equivalent requirements of the label specified by the Ordering Party If the Contractor is unable to obtain the label specified by the Ordering Party or an equivalent label for reasons beyond its control the Ordering Party shall within a time limit set by it accept other equivalent means of proof in particular manufacturer s documentation provided that the Contractor proves that the construction works supplies or services to be performed by it meet the requirements of the specified label or specific requirements specified by the Ordering Party 7 The use in the design documentation of a requirement for a certificate issued by a conformity assessment body or a test report conducted by that body as evidence of compliance with the requirements or characteristics specified in the description of the subject matter of the contract the offer evaluation criteria or the contract performance conditions means that the Ordering Party also accepts certificates issued by other equivalent conformity assessment bodies The Ordering Party also accepts other appropriate evidence in particular the manufacturer s technical documentation in the event that a given Contractor does not have access to certificates or test reports or the ability to obtain them within a reasonable time provided that this lack of access cannot be attributed to a given Contractor and provided that the Contractor proves that the construction works supplies or services they perform meet the requirements or criteria specified in the description of the subject matter of the contract the offer evaluation criteria or the requirements related to the performance of the contract 8 If the description of the subject matter of the contract includes a provision resulting from the KNR or KNNR indicating the need to use specific equipment with specific parameters in the performance of the contract the Ordering Party permits the use of other equipment provided that it ensures the achievement of the assumed design parameters and does not pose a risk of non-compliance of the performed work with the technical documentation 9 In the case of descriptions using standards equivalent solutions are considered to be those that ensure compliance with the minimum requirements specified in the standard at a level no worse than that described in the relevant standards Standards cited in the ToR unless specifically specified are understood to be current standards In other cases description of the subject of the contract using technical assessments technical specifications and technical reference systems equivalent is considered to be a product material or system with technical functional and quality parameters no worse than those specified in the description of the subject of the contract 10 The completed in accordance with the Information and Promotion Guide for Applicants and Beneficiaries of European Funds for 2021-2027 The Contractor must agree on the design content and location of the
