Requirements for post-warranty service 1) Post-warranty service includes: a) service inspections in accordance with the manufacturer’s requirements, b) repair and replacement (within the offer price) of parts with brand new ones, except when the failure is caused by improper operation of the medical equipment, c) all repairs, inspections, maintenance, together with spare parts and materials needed for their performance, d) software upgrade along with system configuration, if necessary, in consultation with the Ordering Party. 2) The Contractor will submit a schedule of inspections (i.e., the months in which inspections will be performed) to the Ordering Party for approval within 14 days of the contract date. 3) Agreed-upon specific inspection dates will be communicated in writing via email. 4) The Contractor will be obligated to proceed with the inspection according to the schedule. 5) The Contractor will be obligated to dispose of any removed components in accordance with applicable regulations. 6) The Contractor will be obligated to guarantee the availability of parts for a period of 24 months from the contract date. 7) The Contractor will be obligated to perform the subject of the contract at the Ordering Party's premises. 8) If inspection/repair is necessary outside the Ordering Party's premises, the Contractor will be obligated to transport the equipment to its premises at its own expense and risk. Transport of the equipment from the inspection/repair site to the Ordering Party's premises will be performed at the Contractor's expense and risk. 9) After completing the inspection/repair, the Contractor will be obligated to issue a paper document approving the equipment for further use and to make the required entries in the technical documentation of the medical equipment. 10) Service response – commencement of repair activities within 24 hours of reporting the failure (applies to business days). 4. Inspection requirements: 1) The Contractor undertakes to perform the inspection: a) in accordance with applicable regulations, b) in accordance with the requirements of the medical equipment manufacturer, c) in an active facility in a manner enabling its operation and not causing disruptions or excessive nuisance. 2) The Contractor shall submit a schedule of inspections (i.e. months in which the inspections will be performed) to the Ordering Party for approval within 14 days of the date of conclusion of the contract. 3) In the event thatIf the need for repair/replacement of a part is identified, the Contractor shall ensure its completion within 14 days based on a separately issued offer. 4) The Contractor shall be obligated to perform the subject of the contract at the Ordering Party's premises. 5) If an inspection is necessary outside the Ordering Party's premises, the Contractor shall be obligated to transport the equipment to its premises at its own expense and risk. Transport of the equipment from the inspection site to the Ordering Party's premises shall be carried out with the best efforts and at the Contractor's expense and risk. 6) After completing the inspection, the Contractor shall be obligated to issue a paper document approving the equipment for further operation and to make the required entries in the technical documentation of the medical equipment. 5. The Ordering Party allows the submission of equivalent offers with parameters no worse or better than those specified by the Ordering Party, if the description of the subject of the contract could indicate that the subject of the contract was identified by indicating a trademark, patent, or origin. By equivalent solutions, the Ordering Party understands those that at least meet the requirements specified in the terms of reference and are characterized by technical, quality, and performance parameters no worse than those specified in the description of the subject of the contract. A contractor offering solutions equivalent to those described by the contracting authority must include in its bid a summary of all equivalent solutions offered and demonstrate their equivalence to the solutions described in the tender documentation, indicating the name and position of the description of the subject matter of the contract to which they pertain. The description of the offered equivalent solutions should be sufficiently detailed to enable the contracting authority to evaluate the offer and determine whether the offered solution is equivalent. Where the documentation indicates the origin (brand, trademark, manufacturer, supplier) of materials or equipment, or the standards, approvals, specifications, and systems referred to in Art. 99–101 of the Act, the contracting authority will allow equivalence. If the description of the subject matter of the contract contains references to standards, technical assessments, technical specifications, and technical reference systems referred to in Art. 101, paragraph 1, item 2) and paragraph 3 of the Public Procurement Law, the contracting authority will allow solutions that are equivalent in terms of procedure methodology, scope, functionality, applicability, storage, operation, and other features described in the standards. Taking the above into account, the Ordering Party indicates that in all places in the description of the subject of the contract where the description is made by referring to specific standards, solutions equivalent to the described ones are permitted, and at the same time in each place the Ordering Party introduces the term "or equivalent" (legal basis: Article 42 paragraph 3 of Directive 2014/24/EU). 6.The remaining terms of the contract are specified in Annex 6 to the tender specifications ("Draft contract provisions"). 7.
