The subject of the order also includes: • delivery of waste containers, • delivery of access cards, • providing access to the IT system in a remote model, • transport, assembly and commissioning, • training of the Ordering Party’s staff, • conducting a functional test, • preparing and conducting an information and educational campaign, • providing a quality guarantee. 4. The gazebos will be brand new, free from physical and legal defects. 5. A detailed description of the subject of the contract is included in Appendices No. 2 and No. 2a to the Technical Specifications. 6. If the subject of the contract includes or may include an ICT product, ICT service or ICT process indicated in the recommendation referred to in art. 33 sec. 4 of the Act of 5 July 2018 on the national cybersecurity system (Journal of Laws of 2026, items 20 and 252), the contractor is obliged to offer only such ICT products, ICT services and ICT processes that on the date of submission of offers: 1) are not indicated in the recommendation referred to in art. 33 sec. 4 of the Act of 5 July 2018 on the national cybersecurity system, stating their negative impact on the fundamental interest of state security; 2) do not include an ICT product the type of which was specified in the decision on recognizing the supplier as a high-risk supplier referred to in art. 67b sec. 15 of the Act of 5 July 2018 on the national cybersecurity system, nor the ICT service or ICT process specified in this decision. 6.1. If the contractor offers ICT solutions, it is obliged to clearly identify each offered ICT solution in its offer, in particular by indicating: 1) the name of the solution, 2) the manufacturer or supplier, 3) the type, model, version or other designation allowing its identification, 4) the function performed within the scope of the contract. 6.2. The inability to clearly identify the offered ICT solution shall be the responsibility of the Contractor. 6.3. If the content of the offer, documents submitted with the offer, or the Contractor's explanations indicate that the offer includes the solution referred to in paragraph 6 or 6.1 of this Chapter, the offer shall be subject to rejection pursuant to art. 226 paragraph 1 item 17 or item 19 of the Act of 11 September 2019 - Public Procurement Law. 7. The offer should include the valuation of all accompanying services indirectly related to the subject matter of the procedure, i.e. in particular: customs duties, administrative fees, costs of transport, loading and unloading, assembly, commissioning, training of the Ordering Party's employees, conducting tests, preparation and conduct of an information and educational campaign, insurance en route to the Ordering Party's headquarters, and all other costs necessary for the proper performance of the order. 8. The minimum warranty conditions and conditions for the performance of the subject of the order are specified in Appendix No. 4 to the ToR. 9. The order is carried out as part of the project "Modernization of the Municipal Waste Processing Plant MPGK Sp. z o.o. in Chełm" co-financed under Measure 3.6 Waste management in the public sector (project type 1, 3, 4) of Priority III Protection of environmental resources and climate of the European Funds for Lublin 2021-2027 program. with tender notice no. 671699-2026 published on 30 Sep 2026.
