Availability and Performance Monitoring Service (G1U2), described in detail in Appendix No. 1B to the ppu; 1.1.3. Installation Service (G1U3), described in detail in Appendix No. 1C to the ppu; 1.2. Quality Assurance Services Group (G2), described in detail in Appendix No. 2 to this document, including: 1.2.1. Defect Removal Service (G2U1), described in detail in Appendix No. 2A to this document; 1.2.2. Code and Documentation Management Service (G2U2), described in detail in Appendix No. 2B to this document; 1.2.3. Integration and Certification Service (G2U3), described in detail in Appendix No. 2C and 2C1 to this document; 1.3. IT System Administration Services Group (G3), described in detail in Appendix No. 3 and 3A to this document 1.4. Development (Modification) Services Group (G4), described in detail in Appendix No. 4 and 4A to this document 1.5. Regardless of the above groups of Services, the Contractor is obliged to: 1.5.1. provision of the Operational Orders Service, described in detail in Appendix No. 5 to the employment contract; 1.5.2. implementation of the activities provided for the Transition Period, described in detail in point 6 of the employment contract and Appendix No. 7 to the employment contract; 1.5.3. implementation of the activities provided for the Handover of Services, described in detail in point 15 of the employment contract. 2. The Contractor will accept Notifications within the Response Times (in accordance with the scope described in point 2 of Appendix No. 9 to the employment contract) and will ensure the operation of the Contractors Project Office in accordance with the scope described in point 3.43 of Appendix No. 13 to the employment contract. 3. The Ordering Party requires that the Contractor or a subcontractor employ persons performing the activities referred to in point 2, due to the fact that the performance of these activities consists in performing work in the manner specified in art. 22 § 1 of the Act of 26 June 1974 - Labour Code. All persons performing the activities indicated in point 2 must be employed throughout the entire period of contract execution. 4. The Ordering Party requires that the Contractor, within 15 Business Days from the date of signing the Agreement and within 10 Business Days of the first month of a given calendar quarter throughout the entire period of Contract execution, submit to the Ordering Party a declaration of the manner of employment of the persons and the activities they perform, referred to in point 2.In order to verify the employment by the Contractor or subcontractor under an employment contract of individuals performing the activities indicated by the Ordering Party, referred to in point 2, the Ordering Party reserves the right to request, in particular: 4.1. a statement from the employed employee, 4.2. a statement from the Contractor or subcontractor regarding the employment of the employee under an employment contract, 4.3. a certified true copy of the employed employees employment contract, 4.4. other documents containing information, including personal data, necessary to verify employment under an employment contract, in particular the first and last name of the employed employee, the date of conclusion of the employment contract, the type of employment contract, and the scope of the employees responsibilities. 5. The Ordering Party reserves the right to verify compliance with the requirement referred to in point 3, exercising its rights under the Agreement. The Ordering Party reserves the right to contact the appropriate supervisory and labor law enforcement authority to verify the Contractors compliance with the requirement referred to in point 3. If a violation of the requirement referred to in point 3 is identified, the Ordering Party will set the Contractor a deadline of no longer than 5 Business Days to remedy the identified violation and to provide evidence of such remedy within 14 days. If the Contractor fails to remedy the identified violation, the Ordering Party reserves the right to charge the Contractor a contractual penalty of PLN 2,000.00 (in words: two thousand zlotys 00/100) for each identified violation of any of the requirements referred to in points 3 and 4. 6. The Maintenance Service and the Modification Service will be financed by the Ordering Party through separate grants from the state budget, subject to separate settlement principles. Each service is a separate service with a specific scope and actual value, which should be reflected in the offer in accordance with the Offer Form. Therefore, the value of the Modification Service must constitute at least 61% of the offer price. The implementation of the Modification Service will be based on the current needs of the Ordering Party. 7. The order will be executed in Polish. The Contractor will be obligated to ensure that during the execution of the order, the persons representing the Contractor communicate with the Ordering Party and that documents are prepared in Polish. 8. The Ordering Party requires that the subject of the order be executed under the terms and conditions specified in the PPU and the annexes, constituting Appendix No. 10 to the ToR.necessary to verify employment under an employment contract, in particular the name and surname of the employed employee, the date of conclusion of the employment contract, the type of employment contract, and the scope of the employees responsibilities. 5. The Ordering Party reserves the right to verify compliance with the requirement referred to in point 3, using the rights arising from the Agreement. The Ordering Party reserves the right to contact the appropriate supervisory and control authority over compliance with labor law to verify the Contractors compliance with the requirement referred to in point 3. If an incident violating the requirement referred to in point 3 is detected, the Ordering Party will set the Contractor a deadline of no longer than 5 Business Days to remedy the identified violation and to provide evidence of remedying such violation within 14 days. If the Contractor fails to remedy the identified violation, the Ordering Party reserves the right to charge the Contractor a contractual penalty of PLN 2,000.00 (in words: two thousand zlotys 00/100) for each identified violation of any of the requirements referred to in points 3 and 4. 6.
